Economic Development

Dumping and Countervailing Duties Act 1988

Imposition of Anti-dumping Duties: Oral Liquid Paracetamol From the Republic of Ireland

On 30 March 2005, notice was given by the Minister of Commerce (published in the New Zealand Gazette, 7 April 2005, No. 62, page 1548) of a final determination, pursuant to section 13 of the Dumping and Countervailing Duties Act 1988 (“the Act”), in relation to the importation or intended importation of the goods specified in the First Schedule to this notice (the “subject goods”), that:

(a) the subject goods are dumped; and

(b) by reason thereof, there is a threat of material injury to the New Zealand industry.

Notice is now hereby given that, acting pursuant to subsections 14 (1) and 14 (4) of the Act, I have determined that anti-dumping duty be imposed on the subject goods at the amounts set out and detailed in the Second Schedule to this notice.

Also, acting pursuant to section 14 (7) of the Act, I have determined that the Normal Value (Value For Duty Equivalent) (“NV(VFDE)”) amounts imposed pursuant to this notice, shall be terminated entirely with effect on and from 31 March 2005 until the date of this notice.

Description of Goods
Oral liquid paracetamol in various strengths and pack sizes excluding: elixirs and paracetamol in other forms.

The goods are currently classified under tariff item and statistical keys 3003.90.09.10K and 3004.90.19.19G of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Second Schedule

Amount of Anti-dumping Duty

The amount of anti-dumping duty to be paid on demand in respect of each importation of oral liquid paracetamol into New Zealand from Ireland, shall be:

For all suppliers and exporters of the subject goods from Ireland, the amount by which the NV(VFDE) amounts listed below exceed the New Zealand Value For Duty of the goods when entered for consumption in New Zealand.
