Programme

1. Title—This programme is the Exempt Persons Personal Allowance Programme 2006.

2. Commencement—This programme comes into effect on the day after the day on which the Minister gives his approval to it.

3. Purpose—The purpose of this programme is to continue to provide for a personal allowance for exempt persons in long-term residential care who would otherwise be required to contribute the whole of their benefits to the cost of contracted care services provided to them.

4. Interpretation—(1) In this programme, unless the context otherwise requires:

   Act means the Social Security Act 1964;
   allowance means an exempt person’s personal allowance (being the special assistance under this programme); and
   expiry date means the earlier of the dates set out in clause 8.

   (2) Terms otherwise defined in section 3 (1) and in Part 4 of the Act have the same meanings.

5. Application of the Social Security Act—(1) Sections 12, 62, 74, 74A, 77 (1), 80A and 86J of the Act apply to this programme and any exempt person as if the assistance under this programme were a benefit under the Act.

   (2) Nothing in subclause (1) affects or limits the application of any other provision of the Act.

6. Exempt person’s personal allowance—(1) An exempt person in receipt of any benefit is entitled to receive an exempt person’s personal allowance under this programme.

   (2) The amount of an allowance is the same amount as Regulations made under section 155 of the Act prescribe as the amount of a personal allowance for the purposes of Part 3 of Schedule 27 of the Act (not exceeding the amount of the benefits received by the exempt person).

7. Period for which allowance payable—(1) An allowance commences on the date on or after 3 July 2006 on which the exempt person becomes liable, under sections 139 and 142 of the Act, to make payment of any benefit received by the person towards the cost of contracted care services provided to the person.

   (2) An allowance ends on the earliest of the following dates:

   (a) The date on which the exempt person ceases to be entitled to any benefit;
   (b) the date on which the person ceases to be an exempt person or dies;
   (c) the expiry date.

8. Expiry—Unless sooner revoked, this programme expires:

   (a) with the close of 30 June 2007; or
   (b) with the beginning of any earlier day on which the following amendments to the Act (as set out in clauses 6 (2) and 9 of the Social Security (Long-term Residential Care) Amendment Bill) come into force:
   (i) The proposed new definition of personal allowance in section 136; and
   (ii) the proposed new section 142 (1).

Explanatory Note

This note is not part of the programme, but is intended to indicate its general effect.

This programme, which comes into effect on the date the Minister approves it and replaces the Exempt Persons Personal Allowance Programme that expired on 30 June 2006, provides an exempt person in long-term residential care, who would otherwise be required to contribute the whole of the person’s benefits to the costs of the care, with a personal allowance of the same amount as other residents assessed as requiring care are allowed to retain from their benefits, but not exceeding the amount of the benefits the person receives.

**Amendments to Transit New Zealand Bylaw 2005/7*
Maximum Speeds of Vehicles on State Highways**

Pursuant to section 61 (3) of the Transit New Zealand Act 1989 and clause 2.6 of the Land Transport Rule: Setting of Speed Limits 2003 (Rule 54001), Transit New Zealand hereby amends the following bylaw.

Amendments

1. These amendments shall come into force 28 days after publication in the New Zealand Gazette.

2. The Transit New Zealand (Maximum Speeds of Vehicles on State Highways) Bylaw 2005/7* is hereby amended by:

   (a) Replacing line 436 in Schedule 3 to read:
   "On: SH1
   At: Otaihanga
   From: RP 1012/7.77 to RP 1012/10.26
   Distance from nearest Road/Feature:
   400m north of Otaihanga Road to the southern abutment of the bridge over Nikau Palm Grove.
   Speed Restriction (km/h): 80"

   (b) Replacing line 437 in Schedule 3 to read:
   "On: SH1
   At: Paraparaumu North
   From: RP 1012/10.26 to RP 1023/1.01
   Distance from nearest Road/Feature:
   Southern abutment of the bridge over Nikau Palm Grove to 370m north of Ihakara Street.
   Speed Restriction (km/h): 50"

   (c) Replacing line 490 in Schedule 3 to read:
   "On: SH6
   At: Wakefield North
   From: RP 131/10.91 to RP 131/11.95
   Distance from nearest Road/Feature:
   430m north-east of Bird Road to 50m north-east of Franklyn Close.
   Speed Restriction (km/h): 70"
