(i) in the case of a substance described in Schedule 1 with variation code 20, when the
impurity is present at a concentration of less than 1 g/kg; or

(ii) in the case of a substance described in Schedule 1 with variation code 21, when the
impurity is present at a concentration of less than 10 g/kg.

(4) Information on an impurity that is required under subclause (3) must include—

(a) its chemical name;

(b) its Chemical Abstract Service Registry number (if available); and

(c) its maximum concentration in the substance.

3 Type E buildings – compliance plans

(1) In this clause, existing type E building means a building or storage place approved in
accordance with the Dangerous Goods (Class 3 – Flammable Liquids) Regulations 1985 as a
type E building that was in use immediately before 1 July 2006 to store or house a hazardous
substance described in Schedule 1.

(2) An existing type E building is not required to comply with the provisions of Schedule 10 to the
Hazardous Substances (Dangerous Goods and Scheduled Toxic Substances) Transfer Notice
2004 (except as required under this clause) if—

(a) it is used for the purpose for which it was used immediately before 1 July 2006; and

(b) the person in charge of it complies with clauses 34(3) to (6) of Part 5 of Schedule 10 to
the Hazardous Substances (Dangerous Goods and Scheduled Toxic Substances) Transfer
Notice 2004 (if required) provided that clause 34(3) shall be read as if references therein
to "this notice" are references to this notice.

4 Ethanol dilutions

(1) This clause applies to the substances described in Table 3 of Schedule 1 when intended for use
as an alcoholic beverage.

(2) Nothing in the Act, or any regulations or notice made under the Act (including this notice)
shall apply to any such substance—

(a) when the substance is stored in containers of not more than 5 litres capacity; or

(b) when the ethanol content of that substance is not more than 15% by volume, irrespective
of the container(s) capacity.
