Changes to controls

Control – Hazardous Substances (Classes 1 to 5 Controls) Regulations 2001 Changes to Controls

Regulations 7, 8, 55, 56, 58, 59, 60 to 70, 76, 77, 81 and 83

The regulations apply to each hazardous substance described in Table 3 of Schedule 1 as if regulations 7, 8, 55, 56, 58, 59, 60 to 70 (inclusive), 76, 77, 81 and 83 were omitted when the following requirements are met:

(a) the substance is intended for use as an alcoholic beverage; and

(b) the substance is stored in containers of greater than 5 litres capacity at premises used for storing, processing or handling of alcoholic beverages; and

(c) the area where the substance is stored is equipped with a drainage and drenching system and a vapour detector designed and constructed in accordance with—

(i) Appendix G of AS 1940: 2004; The Storage and Handling of Flammable and Combustible Liquids; or

(ii) a code of practice approved by the Authority under section 78 of the Act that specifies requirements equivalent to the requirements specified in subparagraph (i); and

(d) the containers are constructed of stainless steel, concrete or such other material specified under a code of practice approved by the Authority under section 78 of the Act.

New regulation 56A

The regulations apply to each hazardous substance described in Schedule 1 with variation code 1 as if the following regulation were inserted immediately after regulation 56:

56A Exception to approved handler requirement for transportation of packaged classes 2, 3 and 4 substances

(1) Regulation 56 is deemed to be complied with if—

(a) in the case of a hazardous substance being transported on land—

    (i) in the case of a hazardous substance being transported by rail, the person who drives the rail vehicle that is transporting the substance is fully trained in accordance with an approved safety system under section 6D of the Transport Services
