Pursuant to section 119 of the Law Practitioners Act 1982, notice is hereby given that on 10 February 2006, the New Zealand Law Practitioners Disciplinary Tribunal ordered as follows:
THAT
- Pursuant to sections 112 (2) (a) and 113 of the Law Practitioners Act 1982, the name of Christopher Lloyd Harder be struck off the Roll of Barristers and Solicitors of the High Court of New Zealand, effective 10 March 2006 at 12.00 midday, on the following conditions:
(a) The practitioner is to practise under the supervision of a person approved by the Auckland District Law Society and the chair of the New Zealand Law Practitioners Disciplinary Tribunal until 10 March 2006 at 12.00 midday;
(b) During the supervision period, the practitioner is not to receive fees direct from clients except through a solicitor’s trust account or through the Legal Services Agency;
(c) The practitioner is not to take on any new instructions from clients;
(d) During the supervision period, the practitioner is to report by Friday at 2.00 p.m. of each week to his supervisor and the supervisor is to report to the Auckland District Law Society by 12.00 midday the following Monday; and
(e) The supervisor is to have full access to the practitioner’s files, his premises and documents for the purposes of carrying out the supervision.

All affidavits filed with the tribunal be sealed, placed on file, and not opened without further order of the tribunal.

The practitioner pay to the New Zealand Law Society the sum of $22,226.35.

Pursuant to section 119 of the Law Practitioners Act 1982, notice is hereby given that on 7 December 2005, the New Zealand Law Practitioners Disciplinary Tribunal ordered as follows:
THAT

The practitioner Mark Henley-Smith, of Auckland, be suspended from practice as a barrister and solicitor for a period commencing on Friday, 27 January 2006 at 5.00 p.m. and concluding on Friday, 31 March 2006 at 5.00 p.m.

For a period of two years commencing on 1 April 2006, the practitioner shall:
(a) make his practice available for inspection at six-monthly intervals by an audit inspector appointed by the New Zealand Law Society. The costs of such inspections are to be met by the practitioner.
(b) take advice in relation to the management of his practice from such a person or persons to be nominated by him and approved by the Auckland District Law Society and the chair of the tribunal before 1 April 2006. The cost of such advice to be met by the practitioner.

The practitioner pay to the New Zealand Law Society the sum of $5,679.29.

The practitioner pay to Auckland District Law Society the sum of $10,000.00.
