Telecommunications Act 2001

Schedule 3 Investigations into Amending the Roaming and Co-location Services

Pursuant to clause 1 (3) of Schedule 3 of the Telecommunications Act 2001 (“the Act”), the Commerce Commission (“the Commission”) gives public notice that it has decided, under clause 1 of Part 1 and clause 8 of Part 2 of Schedule 3 to the Act, to commence an investigation into:

  • amending the terms of the national roaming service;
  • moving the national roaming service from a specified to a designated service; and
  • moving the co-location service from a specified to a designated service.

Under clause 1 (1) of Schedule 3 to the Act, the Commission may on its own initiative commence an investigation into whether or not Schedule 1 of the Act should be altered. The Commission, under clause 8 (1) of Schedule 3 of the Act, may on its own initiative commence an investigation into whether or not a service may be altered by moving it from Part 3 to Part 2 of Schedule 1 of the Act.

The Commission is satisfied that there are reasonable grounds for commencing an investigation into amending the roaming and co-location services, and these reasons are published on the Commission’s web site at:

Determination of New Organisms

Pursuant to section 26 of the Hazardous Substances and New Organisms Act 1996, the Environmental Risk Management Authority hereby determines that:

Lactobacillus plantarum (Orla-Jensen 1919) Bergey et al 1923; and

Cyclotella meneghiniana (Kützing 1844)

are not new organisms.

Land Transport Rule: Setting of Speed Limits 2003 (Rule 54001)

*Amendments to Transit New Zealand Bylaw 2005/7
Maximum Speeds of Vehicles on State Highways

Pursuant to section 61 (3) of the Transit New Zealand Act 1989 and clause 2.6 of the Land Transport Rule: Setting of Speed Limits 2003 (Rule 54001), Transit New Zealand hereby amends the following bylaw.

Amendments

  1. These amendments shall come into force 28 days after publication in the New Zealand Gazette.

  2. The Transit New Zealand (Maximum Speeds of Vehicles on State Highways) Bylaw 2005/7* is hereby amended by:

    (a) Replacing line 677 in Schedule 3 to read:

    “Transit NZ Region: 13
    SH No.: 6
    Locality: Frankton
    From (RP): 983/11.470 to (RP): 996/0.200
    Distance from nearest Road/Feature:
    From 470m east of Frankton Road (SH6A) to 200m south of Frankton Road (SH6A).
    Speed Restriction (km/h): 50
    New Zealand Gazette Reference: 16 November 2006, No. 137, page 4006”

    (b) Replacing line 678 in Schedule 3 to read:

    “Transit NZ Region: 13
    SH No.: 6
    Locality: Frankton
    From (RP): 996/0.200 to (RP): 996/2.550
    Distance from nearest Road/Feature:
    From 200m south of Frankton Road (SH6A) to 170m south of Peninsula Road.
