in force in the Dependency are duly observed and
complied with in every respect, and to do all things
necessary or expedient for the peace, order, and good
government of the Dependency, and to safeguard and
preserve Her Majesty’s rights and sovereignty over
and in respect of the Dependency:
D. It is now expedient that Vicki Elaine Addison,
Peter James Brookman, Peter James Cleary and
Michael Patrick Mahon be appointed officers of
the Government of the Dependency:
Now therefore I, The Honourable Anand Satyanand, the
Governor-General of New Zealand, and as such the Governor
of the Dependency, appoint

Peter James Brookman
Peter James Cleary
Michael Patrick Mahon
to be officers of the Government of the Dependency while
they act as Senior New Zealand Representatives at Scott
Base during the period beginning with this appointment
and ending, in the case of Vicki Elaine Addison, with the
close of 15 October 2008 and, in the case of Peter James
Brookman, Peter James Cleary and Michael Patrick Mahon,
with the close of 28 February 2009:
I confer on Vicki Elaine Addison, Peter James Brookman,
Peter James Cleary and Michael Patrick Mahon, while
they hold office as officers of the Government of the
Dependency, all the powers exercisable in New Zealand by
a Justice of the Peace, and also the powers exercisable in
New Zealand by a Coroner:
Vicki Elaine Addison, Peter James Brookman, Peter James
Cleary and Michael Patrick Mahon are to exercise their
functions at such places within the Dependency as may be
directed by an officer of the Government of the Dependency
who has the general executive and administrative authority
in preserving Her Majesty’s rights and sovereignty and the
laws in force in the Dependency.
As witness the hand of His Excellency the Governor-
General as the Governor of the Ross Dependency,
this 31st day of October 2006.

Electricity Industry Reform Act 1998
Notice of Exemption—Westpower Limited
The Commerce Commission (“Commission”), pursuant to
section 81 of the Electricity Industry Reform Act 1998
(“EIR Act”), exempts Westpower Limited (“Westpower”)
from the application of section 17 of the EIR Act in respect
of the “cross-involvement” (as that term is defined in the
EIR Act) that would be created through its investment in
a hydro generation plant, located on the Amethyst River
at Harihari, South Westland, through the joint venture
proposal outlined in its application for exemption registered
by the Commission on 4 August 2006.
The exemption is subject to the following conditions:
(a) The joint venture company and Westpower’s
electricity lines business must comply with rules
1 to 6 and 11 to 15 of the Arms Length Rules set
out in Schedule 1 of the EIR Act.
(b) Westpower must not be involved directly or
indirectly in the selling of electricity to any
end-use customer connected to Westpower’s
electricity network. This does not preclude the
sale of electricity to an electricity retailer.
(c) This exemption does not extend to engaging in the
financial hedging of risks relating to the price of
electricity in New Zealand beyond the nameplate
generation capacity (6 MW per annum) of the
proposed hydro generation plant.
(d) This exemption is specific to the cross-involvements
created through Westpower’s involvement in the
proposed joint venture. It does not extend to any
other interest or existing or future cross-involvement
of Westpower.
The Commission may vary or revoke the exemption in
accordance with section 81 (5) of the EIR Act.
The exemption takes effect from the date of publication of
this notice in the New Zealand Gazette.

Electricity Governance Regulations 2003
Electricity Governance Regulations (Exemption
No. 32 (Genesis Power Limited)) Exemption
Notice 2006
Pursuant to Regulation 194 (2) of the Electricity
Governance Regulations 2003, the Electricity Commission
(“Commission”) gives the following notice.
Notice
- Title and commencement—(1) This notice is the
Electricity Governance Regulations (Exemption No. 32
(Genesis Power Limited)) Exemption Notice 2006.
(2) This notice comes into force on 1 December 2006
(“commencement date”).

Exemption—Genesis Power Limited (“Genesis”) is
exempted from compliance with Rule 11.5.2 of Section IV
of Part C of the Electricity Governance Rules 2003
(“Rules”). -
Terms and conditions—This exemption is granted on
the following conditions:
(a) It only applies in relation to Genesis’ plant known as
“e3p” or “HLY5”; and
(b) it expires on the earlier of either:
(i) six months following the commencement date;
or
(ii) the date agreed between Genesis and the system
operator as being the end of commissioning
point in the commissioning plan produced for
HLY5 in accordance with Technical Code A,
Schedule C3 of Part C of the Rules.
- Reasons for granting the exemption—The reasons for
granting this exemption are:
(a) the possibility that Genesis’ commercial incentives
in relation to the event charge could lead to delays in
HLY5 commissioning or unproven reliability during
the winter of 2007; and
(b) commissioning of HLY5, given its size and
complexity and the contribution it is expected to
