Amendment of Notice of Direction for Appointment

of a Limited Statutory Manager for the Board of
Trustees of Greenmeadows Intermediate
School (1300)

Pursuant to section 78M of the Education Act 1989, I amend
the notice dated the 30th day of June 2005, and published
in the New Zealand Gazette, 7 July 2005, No. 105, page
2477, regarding the appointment of a limited statutory
manager for the Greenmeadows Intermediate School
Board of Trustees because of risk both to the operation
of the school and to the educational performance of the
students at the school.

The following functions, powers and duties of the board are
to be vested in a limited statutory manager:

● All functions, powers and duties of the board as an
employer (whether statutory or otherwise).

A limited statutory manager must also advise the board on
the following:

● Student achievement; and
● curriculum planning and delivery.

The following condition applies to the exercising of the
powers by a limited statutory manager:

● Staff appointments must be made in consultation with
the board.

This notice takes effect the day after the date of publication
of this notice.

Fisheries (Kaimoana Customary Fishing) Notice

(No. 3) 2006 (No. F376)

Pursuant to Regulation 9 of the Fisheries (Kaimoana
Customary Fishing) Regulations 1998, the Programme
Manager (Deed of Settlement Implementation Programme)
at the Ministry of Fisheries (acting pursuant to a delegated
authority in accordance with section 41 of the State Sector
Act 1998) hereby gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be
    cited as the Fisheries (Kaimoana Customary Fishing) Notice
    (No. 3) 2006.

(2) This notice shall come into effect the day after the date
of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) “customary food gathering” has the same meaning as
defined in the Fisheries (Kaimoana Customary Fishing)
Regulations 1998.

(b) “Tangata Kaitiaki” are local dialect words that have the
same meaning as “Tangata Kaitiaki/Tiaki”, a term that is
defined in the Fisheries (Kaimoana Customary Fishing)
Regulations 1998.\n
(c) “Tangata Kaitiaki” means the person or persons
appointed under Regulation 9 of the Fisheries (Kaimoana
Customary Fishing) Regulations 1998 for the
management of customary food gathering within an
area/rohe moana.

(d) “area/rohe moana” means one of those areas described in
clause 3 of this notice.

(e) any geographical co-ordinates described in clause 3 of
this notice are in terms of the WGS84 datum.

  1. Appointment of Tangata Kaitiaki—On 31 July 2006,
    the Associate Minister of Fisheries (acting pursuant to a
    delegated authority) confirmed, under Regulation 9 (1) of
    the Fisheries (Kaimoana Customary Fishing) Regulations
    1998, the appointment of:

(a) Brad Bluett, Materoa Dodd, Patrick Fairlie, Meri Hepi,
John Hohapata-Oke, Wiremu Hunia, Rapata Kopae, Joe
Mason, Pouroto Ngaropo, Sterling Titoko Ratema,
Helen Sisley, John Stipich, Te Kani Wharewera, Pitau
Williams and Ron Wineti as Tangata Kaitiaki to manage
customary food gathering within the area/rohe moana
described by a line beginning on the coastline at a point
north of Wahieroa (37°53.8′S 176°49.9′E), then northerly
for 24 nautical miles to a point (37°29.8′S 176°47.0′E),
then south-easterly to a point (37°34.4′S 177°00.7′E),
then southerly for 24 nautical miles to a point on the
coastline at the mouth of the Maraetotara Stream
(37°58.3′S 177°03.7′E), then generally westerly
following the coastline to the point of commencement;
and

(b) Tomairangi Fox, Anthony Olsen and Jim Rota as
Tangata Kaitiaki to manage customary food gathering
within the area/rohe moana described by a line
beginning on the coastline at a point north of Wahieroa
(37°53.8′S 176°49.9′E), then northerly for 24 nautical
miles to a point (37°29.8′S 176°47.0′E), then
south-easterly to a point (37°30.8′S 176°50.7′E),
then southerly for 24 nautical miles to a point on
the coastline (37°54.7′S 176°53.6′E), then generally
westerly following the coastline to the point of
commencement.

  1. Confirmation of tangata whenua—Ngāti Awa, as
    represented by Te Rūnanga o Ngāti Awa, is confirmed as
    the tangata whenua of the area/rohe moana to which the
    appointment of Tangata Kaitiaki relates.

  2. Power to authorise the taking of fisheries resources
    for customary food gathering
    —The Tangata Kaitiaki may
    authorise any individual to take fisheries resources managed
    under the Fisheries Act 1996, other than those resources that
    are taken in fresh water, for customary food gathering
    purposes from within the whole or any part of the area/rohe
    moana for which they have been appointed as Tangata
    Kaitiaki.
