Pursuant to the Public Works Act 1981, and to a delegation
from the Minister for Land Information, R. J. Sutherland,
Land Information New Zealand:

(a) Pursuant to section 114, declares the land described
in the First Schedule to this notice to be declared road which,
pursuant to section 60 (2) of the Transit New Zealand Act
1989, forms part of State Highway No. 1 and shall remain
vested in the Crown on the date of publication of this notice
in the New Zealand Gazette.

(b) Pursuant to section 119 (1), declares the land
described in the Second Schedule to this notice to be taken
as severance and shall vest in the Crown.

Road Stopped and Amalgamated, and Easement Acquired—Te Waiiti Place, Whangarei

Pursuant to the Public Works Act 1981 and to a delegation
from the Minister for Land Information, Ronald Alistair
Jolly, Land Information New Zealand:

(a) Pursuant to sections 116 and 117, declares the
portion of road described in the First Schedule to this notice
to be stopped and, pursuant to section 120 (3), amalgamated
with the land in Computer Freehold Register NA12C/178,
subject to mortgage C950490.1 and certificate 5640846.1.

(b) Pursuant to sections 20 and 28, declares that, an
agreement to that effect having been entered into, a right
to drain stormwater as an easement in gross, as set out in
Schedule 4 to the Land Transfer Regulations 2002, modified
by the additional condition that any maintenance, repair
or replacement of the stormwater line that is necessary
because of any act or omission by the owner of the servient
land (which includes any agents, employees, contractors,
subcontractors or invitees of the owner) must be carried out
promptly by that owner at the sole cost of that owner or in
such proportion as relates to the act or omission, is hereby
acquired over the land described in the Second Schedule to
this notice and shall vest in the Whangarei District Council
on the date of publication of this notice in the New Zealand Gazette.

Revocation of a Notice for a Road Stopped and Amalgamated—Te Waiiti Place, Whangarei

Pursuant to section 54 of the Public Works Act 1981, and to
a delegation from the Minister for Land Information, Ronald
Alistair Jolly, Land Information New Zealand, hereby
revokes the notice dated 31 January 2005, stopping and
amalgamating a road, published in the New Zealand Gazette,
3 March 2005, No. 45, page 1123.

Reserves Act 1977

Revocation of the Reservation Over Part of a Reserve

Under the Reserves Act 1977, the Community Relations
Manager of the Nelson/Marlborough Conservancy of the
Department of Conservation revokes the reservation as a
local purpose (esplanade) reserve over the land described in
the Schedule and declares that the land may be disposed of
by the Marlborough District Council at current market
value, the proceeds of such sale to be paid into the council's
reserves account, to be used and applied in or towards
the improvement of other reserves under the control of the
council, or in or towards the purchase of other lands for
reserves.
