Notice of Making of Electricity Governance Amendment Rules (No. 25) 2005 and Notice of Reasons for Decision

Pursuant to section 172I of the Electricity Act 1992, I notify the amendment of the Electricity Governance Rules 2003 ("Rules") under section 172H of the Electricity Act 1992.

The empowering provision for the electricity governance regulations in relation to which the Rules are made is section 172D (1) (1) (b) of the Electricity Act 1992.

A brief description of the nature of the amendments is as follows:
● These amendments address concerns regarding the consistency of Part E, correct errors, clarify the Rules, and remove superfluous Rules from Part E of the Rules.

The amendments are made in reliance on section 172F (3) of the Electricity Act 1992.

Pursuant to section 172Z (4) of the Electricity Act 1992, the reasons for my decision to amend the Rules are that:
● the Rule changes will improve consistency within the Rules; and
● the Rule changes will make minor clarifications to Part E of the Rules.

These Rules come into force on 7 July 2005.

Pursuant to section 172I of the Electricity Act 1992, I notify the amendment of the Electricity Governance Rules 2003 ("Rules") under section 172H of the Electricity Act 1992.

The empowering provisions for the electricity governance regulations in relation to which the Rules are made are sections 172D (1) (1) (a) and 172D (1) (1) (b) of the Electricity Act 1992.

A brief description of the nature of the amendments is as follows:
● These amendments address concerns regarding the consistency of the testing of measuring transformers’ rules (as set out in the Code of Practice D2 and Code of Practice D3 of Schedule D1 of Part D of the Rules).

The amendments are made in reliance on section 172F (3) of the Electricity Act 1992.

Pursuant to section 172Z (4) of the Electricity Act 1992, the reasons for my decision to amend the Rules are that:
● the Rule changes will improve consistency within the relevant codes of practice and remove concerns expressed by those who have to apply them; and
● the Rule changes will also ensure that the costs of calibration of metering installations and their components are kept to the minimum necessary to ensure that overall accuracy requirements are met.

These Rules come into force on 7 July 2005.

Notice of Making of Electricity Governance Amendment Rules (No. 29) 2005 and Notice of Reasons for Decision

Pursuant to section 172I of the Electricity Act 1992, I notify the amendment of the Electricity Governance Rules 2003 ("Rules") under section 172H of the Electricity Act 1992.

The empowering provision for the electricity governance regulations in relation to which the Rule is made is section 172D (1) (1) (b) of the Electricity Act 1992.

This Rule amendment amends the definition of "availability cost" contained in Part A of the Rules to correct a drafting error that results in the double charging of the reserve costs arising from dispensations.

The amendment is made in reliance on section 172F (3) of the Electricity Act 1992.

Pursuant to section 172Z (4) of the Electricity Act 1992, the reasons for my decision to amend the Rules are that:
● the amendment prevents the double-charging of reserve costs from dispensations in allocating reserve costs; and
● the amendment eliminates the cross-subsidy from compliant to non-compliant generators.

These Rules come into force on 8 July 2005.
