Road to be Stopped and Made Subject to a Building Restriction—State Highway No. 6, Whakatu Drive, Nelson City

Pursuant to section 116 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares the portion of road adjoining or passing through the land described in the Schedule to this notice to be stopped and shall remain vested in the Crown and further declares, pursuant to section 236, shall be subject to the following restrictions:

No structure of any type shall be erected on the land other than:

(a) standard rural fencing PROVIDED THAT a greater standard of fencing may be erected if required to meet statutory, regulatory or code requirements in respect of the use of the land; or

(b) children’s play facilities; or

(c) one building to be restricted for use as toilet and ablution facilities only PROVIDED THAT the prior written approval to the building specification shall be obtained from the Crown with such approval not to be unreasonably withheld or delayed.

(c) Pursuant to sections 20 and 50, declares that, pursuant to an agreement to that effect having been entered into, the stopped road described in the Second Schedule to this notice is acquired for education purposes and vested in the Crown on the date of publication of this notice in the New Zealand Gazette.
