Notice of Making of a Recommendation Concerning
the Electricity Governance Rules 2003—
Rule Amendment Proposal No. 25

This notice of a recommendation concerning the Electricity
Governance Rules 2003 (“Rules”), Rule Amendment
Proposal No. 25, is issued by the Electricity Commission
(“Commission”), established under the Electricity Act 1992
(“Act”), pursuant to section 172E (2) (c) of that Act.

Section 172E (2) (c) provides that, no later than 10 working
days after making a recommendation concerning the Rules
to the Minister of Energy, the Commission must publicise
the recommendation and the assessment completed under
section 172F of the Act.

Recommendation

The Commission made a recommendation to amend the
definition of “availability cost” in Part A of the Rules,
in reliance on section 172F (3), on 26 May 2005.

Section 172F (3) provides that the Commission is not
required to comply with section 172F (1) (which relates
to carrying out an assessment) if it is satisfied that the effect
of the recommendation is minor and will not adversely
affect the interests of any person in a substantial way.

In reliance on section 172F (3), no such assessment has been
carried out under section 172F (1) of the Act.

Recommended Amendment to the Rules

The recommended amendment to the definition of
“availability cost” in the Rules is to correct a drafting error
that results in the double charging of the reserve costs
arising from dispensations.

This notice of a recommendation concerning the Electricity
Governance Rules 2003 (“Rules”), Rule Amendment
Proposal No. 39, is issued by the Electricity Commission
(“Commission”), established under the Electricity Act 1992
(“Act”), pursuant to section 172E (2) (c) of that Act.

Section 172E (2) (c) provides that, no later than 10 working
days after making a recommendation concerning the Rules
to the Minister of Energy, the Commission must publicise
the recommendation and the assessment completed under
section 172F of the Act.

Recommendation

The Commission made a recommendation that Rules 7.3,
8.1, 8.1.1, and 8.1.2 of Part E, and Rules 1.3, 2.3, 2.7, 2.8,
and 5.3 of Schedule E2 of Part E of the Rules be amended in
reliance on section 172F (3), on 26 May 2005.

Section 172F (3) provides that the Commission is not required
to comply with section 172F (1) (which relates to carrying

Recommended Amendment to the Rules

concerns regarding the consistency of Part E, correct errors,
clarify the rules, and remove superfluous rules from Part E.

This notice of a recommendation concerning the Electricity
Governance Rules 2003 (“Rules”), Rule Amendment
Proposal No. 49, is issued by the Electricity Commission
(“Commission”), established under the Electricity Act 1992
(“Act”), pursuant to section 172E (2) (c) of that Act.

Section 172E (2) (c) provides that, no later than 10 working
days after making a recommendation concerning the Rules
to the Minister of Energy, the Commission must publicise
the recommendation and the assessment completed under
section 172F of the Act.

Recommendation

The Commission made a recommendation that Rule 11.5.2
of Section IV of Part C of the Rules be amended on 26 May
2005.

Recommended Amendment to the Rules

The recommended amendment to the Rules would change
the way that event charges are calculated by inserting an
administered event charge rate of $1,250.00 per MW per
event into the Rules.

Limits 2003

Variable Speed Limit in School Zones

Pursuant to clause 6.1 of Land Transport Rule: Setting of
Speed Limits 2003 and a delegation from the Director
of Land Transport, I, Peter Graeme Croft, Manager Safer
Roads, approve variable speed limits in school zones in
accordance with the conditions set out in this notice.
