  1. Pursuant to section 172E (3) (b) of the Act, the reasons for my decision not to revoke, replace or amend the Amendment Rules are that:
  • no submission was received that required the Amendment Rules to be revoked, replaced or amended; and

  • the reasons for making the Amendment Rules remain valid.

  1. Copies of the Electricity Governance Rules 2003, including these Amendment Rules, may be inspected free of charge or purchased from the Electricity Commission, Level Seven, ASB Bank Tower, 2 Hunter Street, Wellington.

Notice of Making of Electricity Governance Amendment Rules (No. 27) 2005 and Notice of Reasons for Decision

  1. Pursuant to section 172I of the Electricity Act 1992, I notify the amendment of the Electricity Governance Rules 2003 (“Rules”) under section 172H of the Electricity Act 1992.

  2. The empowering provisions for the electricity governance regulations in relation to which the Rules are made are sections 172D (1) (3) and 172D (1) (4) of the Electricity Act 1992.

  3. Brief descriptions of the nature of the amendments are as follows:

  • Clarify when the system operator must submit the draft policy statement to the Electricity Commission (“Commission”) and when the draft policy statement comes into effect; and

  • require the Commission to use reasonable endeavours to bring the policy statement into effect no later than 1 September each year.

  1. The amendment is made in reliance on section 172F (3) of the Electricity Act 1992.

  2. Pursuant to section 172Z (4) of the Electricity Act 1992, the reasons for my decision to amend the Rules are that:

  • the amendment clarifies the Rules; and

  • the amendment ensures that the Commission has sufficient time to bring a new policy statement into effect.

  1. This Rule comes into force on 19 May 2005.

  2. Copies of the Rules may be inspected free of charge or purchased from the Electricity Commission, Level Seven, ASB Bank Tower, 2 Hunter Street, Wellington.
