Reappointment/appointments to District Health Boards (DHBs)

Pursuant to section 29 (1) (b) of the New Zealand Public Health and Disability Act 2000 and notice to the members under section 28 (2) of the Crown Entities Act 2004, I have reappointed

Aroha Blanche Hudson

as a member of the board of Waitemata DHB; and appointed

Thomas Eruera Mulligan

as a member of the board of Hawke’s Bay DHB; and

Kathleen Frances Joblin

as a member of the board of Whanganui DHB.

The reappointment and appointments above take effect on 18 April 2005 and will end on 9 December 2007.

Notice of Product Ruling

  1. This is a notice of a product ruling made under section 91F of the Tax Administration Act 1994.

  2. Product ruling No. 05/01 was issued on 11 February 2005. It relates to the redemption of units in a superannuation fund and various sections of the Income Tax Act 1994. It will appear in Inland Revenue’s Tax Information Bulletin, Vol. 17, No. 3, of April 2005.

  3. From 27 April 2005, a copy of the ruling may be obtained by writing to the Manager, Field Liaison & Communication (Adjudication & Rulings), National Office, Inland Revenue, P.O. Box 2198, Wellington.

Reference

(1) Her Excellency the Governor-General refers to the Court of Appeal the questions of:

(a) P’s convictions for sexual offences against complainant A, entered in the High Court at Auckland on 8 August 1997; and

(b) P’s sentence for sexual violation against complainant B, imposed in the High Court at Auckland on 10 February 1999.

(2) Her Excellency the Governor-General makes this reference:

(a) under section 406 (a) of the Crimes Act 1961;

(b) on the advice and with the consent of the Executive Council; and

(c) in the light of the background, and for the reasons, stated in the Schedule.

  1. Interpretation—In this Schedule:

“the applicant” means P.

Background

  1. Trial, sentence and appeal for offences against complainant A—(1) On 8 August 1997, the applicant was convicted in the High Court of the following sexual offences against complainant A:

(a) two counts of sexual violation by rape;

(b) three counts of sexual violation by unlawful sexual connection; and

(c) four counts of inducing a girl to do an indecent act.

(2) The applicant’s convictions were based entirely on the credibility of complainant A.
