Notice of Direction for Appointment of a Limited Statutory Manager for the Board of Trustees of Tauhara College (166)
Pursuant to section 78M of the Education Act 1989, I direct
the Secretary for Education to appoint a limited statutory
manager for the Tauhara College Board of Trustees because
of risks to the operation of the school.
The following functions, powers and duties of the board are
to be vested in a limited statutory manager:
- All functions, powers and duties of the board to manage financial operations (whether statutory or otherwise).
A limited statutory manager must also advise the board on
the following:
- The roles and responsibilities for financial management;
and - sound management practice, including appropriate
delegations.
This notice takes effect the day after the date of publication.

I also approve Wednesday, 25 May 2005, as the date for the
first meeting of the board of trustees.

Supplementary Integration Agreement
Pursuant to section 10 of the Private Schools Conditional
Integration Act 1975, notice is given that a supplementary
integration agreement has been signed between the Minister
of Education on behalf of Her Majesty the Queen, acting
through the Senior Manager, National Operations, Ministry
of Education, pursuant to delegated authority, and the
proprietor of the following school:
Hare Krishna School, Auckland.
The said supplementary integration agreement was executed
on 11 March 2005.
A copy of the supplementary integration agreement is
available for inspection without charge by any member of
the public at the local office of the Ministry of Education,
39-45 College Hill, Auckland.

Advocacy Guidelines for the Nationwide Advocacy Service
Pursuant to section 28 (1) of the Health and Disability
Commissioner Act 1994 (“the Act”), I, Annete King,
Minister of Health, hereby approve the following guidelines
made by the Health and Disability Commissioner.

Governing Guidelines
- Empowerment Principle
The concept of rights is inherently linked to the
empowerment principle. Advocacy is committed to the belief
that consumers already have skills and experience on which
to draw to assist them in resolving their concerns. Advocates
are required to be a strong voice for those consumers who
have limited ability to self-advocate, or who are likely to be
experiencing institutional discrimination.
A consumer-centred and flexible focus with access to a
continuum of empowering strategies is required to ensure
the most appropriate approach for each consumer. Working
in an empowering way is based on the belief that it is better
to equip and support consumers to solve their own problems
than to take over their problems and fix them on their
behalf. The empowerment principle supports the consumer
to resolve the current issue with assistance, and to learn
skills and knowledge to develop confidence to self-advocate
if and when similar issues arise in the future.
- Low-Level Resolution
The intention of the Act and the Code of Health and
Disability Services Consumers’ Rights (“the Code”) is to
promote resolution of complaints at the lowest appropriate
level. Often the quickest and most satisfactory way of
dealing with grievances is for the consumer to deal directly
with the actual provider of the service. The nationwide
advocacy service established under the Act is therefore
fundamental to this aim of low-level resolution.
- Code of Practice
Advocacy service providers and advocates shall comply
with the Code, except where such compliance is inconsistent
with these guidelines.
- Interpretation of and Comment on Rights
Advocacy service organisations and individual advocates
shall refer any request for interpretation of the Code to the
Commissioner.
