amendments to Rules 2.4, 4.2, 4.2.1, 4.2.2 and 4.4 of Schedule G7 of Part G, and Rule 2.2 of Appendix 1 of Code of Practice G2 of Schedule G8 of Part G be made, in reliance on section 172F (3), on 24 February 2005.

Section 172F (3) provides that the EC is not required to comply with section 172F (1) (which relates to carrying out an assessment) if it is satisfied that the effect of the recommendation is minor and will not adversely affect the interests of any person in a substantial way.

In reliance on section 172F (3), no such assessment has been carried out under section 172F (1) of the Act.

Recommended Amendment to the Rules

The recommended amendments to Rules 4.3 and 4.3.1 of Schedule G7 of Part G of the EGRs support a set of guidelines for undertaking forward estimate audits, which are intended to encourage auditors to use the same audit methodology.

The EC also recommended the insertion of the following defined terms into Part A of the EGRs in order to clarify the meaning of those rules:

● “historical estimate”;
● “forward estimate”;
● “initial file”; and
● “revised file”.

Consequential amendments to Rules 2.4, 4.2, 4.2.1, 4.2.2 and 4.4 of Schedule G7 of Part G and Rule 2.2 of Appendix 1 of Code of Practice G2 of Schedule G8 of Part G were also recommended to reflect the new defined terms.

Notice of Making of Electricity Governance Amendment Rules (No. 18) 2005 and Notice of Reasons for Decision

  1. Pursuant to section 172I of the Electricity Act 1992, I notify the amendment of the Electricity Governance Rules (“EGRs”) 2003 under section 172H of the Electricity Act 1992.

  2. The empowering provision for the electricity governance regulations in relation to which the EGRs is made is section 172D (1) (1) (b) of the Electricity Act 1992.

  3. A brief description of the nature of the amendments are as follows:

(a) Amend Rules 4.3 and 4.3.1 of Schedule G7 of Part G of the EGRs, to support compliance with guidelines on forward estimate audits;

(b) The following defined terms are inserted into Part A of the EGRs:

● “historical estimate”;
● “forward estimate”;
● “initial file”; and
● “revised file”.

(c) Consequential amendments to Rules 2.4, 4.2, 4.2.1, 4.2.2 and 4.4 of Schedule G7 of Part G and Rule 2.2 of Appendix 1 of the Code of Practice G2 of Schedule G8 of Part G to reflect the new defined terms.

  1. The amendments are made in reliance on section 172r (3) of the Electricity Act 1992.

  2. Pursuant to section 172Z (4) of the Electricity Act 1992, the reasons for my decision to amend the EGRs are that:

● due to the fact that the rules relating to forward estimate audits do not prescribe a methodology for such audits, these amendments are necessary to achieve a standard approach to forward estimate audits;

● the use of the guidelines encourages consistency in carrying out forward estimate audits, which aids the market administrator; and

● the rule changes do not impose substantial new obligations on participants.

  1. These rules come into force on 31 March 2005.

  2. Copies of the EGRs may be inspected free of charge or purchased from the Electricity Commission, Level Seven, ASB Bank Tower, 2 Hunter Street, Wellington.

Recognition of Organisation Having Expertise in Lighting Requirements for Historic Motor Vehicles

Pursuant to 13.7 (b) of Land Transport Rule: Vehicle Lighting 2004 (“the Rule”), made under section 152 of the Land Transport Act 1998, and acting under delegated authority, I, John Patrick White, Manager Safer Vehicle Policy, Land Transport New Zealand, hereby recognise The Vintage Car Club of New Zealand (Inc.) as an organisation having expertise in lighting requirements for historic motor vehicles for the purposes of 1.4 (4) and 2.1 (14) (d) of the Rule.

Pursuant to 2.9 (5) of Land Transport Rule: Vehicle Equipment 2004 (“the Rule”), made under section 152 of the Land Transport Act 1998, and acting under delegated authority, I, John Patrick White, Manager Safer Vehicle Policy, Land Transport New Zealand, hereby specify Bureau Veritas New Zealand Limited as an organisation to verify compliance with the child restraint standard specified in section 2.9 (4) (f) of the Rule.
