Officer of the Government of Ross Dependency Appointed

Background:

A. An Order in Council dated 30 July 1923* (“the order”) made under the British Settlements Act 1887 (UK) appoints the Governor-General of New Zealand to be the Governor of the Ross Dependency (“the Governor”) and vests in the Governor certain powers:

B. The order empowers the Governor to make rules and regulations for the peace, order, and good government of the Dependency:

C. Regulations made by the Governor on 14 November 1923† provide that all persons appointed by the Governor may be empowered to do such things as may be necessary or desirable to ensure that the laws in force in the Dependency are duly observed and complied with in every respect, and to do all things necessary or expedient for the peace, order, and good government of the Dependency, and to safeguard and preserve Her Majesty’s rights and sovereignty over and in respect of the Dependency:

D. It is now expedient that Kevin Richard Rigarlsford be appointed an officer of the Government of the Dependency:

Now therefore I, Dame Silvia Cartwright, the Governor-General of New Zealand, and as such the Governor of the Dependency, appoint

Kevin Richard Rigarlsford

to be an officer of the Government of the Dependency while he acts as Senior New Zealand Representative at Scott Base during the period beginning with this appointment and ending with the close of 28 February 2007:

I confer on Kevin Richard Rigarlsford, while he holds office as an officer of the Government of the Dependency, all the powers exercisable in New Zealand by a Justice of the Peace, and also the powers exercisable in New Zealand by a Coroner:

Kevin Richard Rigarlsford is to exercise his functions at such places within the Dependency as may be directed by an officer of the Government of the Dependency who has the general executive and administrative authority in preserving Her Majesty’s rights and sovereignty and the laws in force in the Dependency.

As witness the hand of Her Excellency the Governor-General as the Governor of the Ross Dependency, this 10th day of February 2005.

Notice of Confirmation of Electricity Governance Amendment Rules (No. 5) 2004

  1. Pursuant to section 172E (3) (b) of the Electricity Act 1992 (prior to amendment by the Electricity Amendment Act 2004), I notify that the Electricity Governance Amendment Rules (No. 5) 2004 (“the amendment rules”), which were made under urgency in accordance with section 172E (3) of the Electricity Act 1992 on 5 August 2004, will not be revoked, replaced or amended.

  2. Pursuant to section 172E (3) of the Electricity Act 1992, the reasons for my decision not to revoke, replace or amend the amendment rules are that:

  • No submissions received on the amendment rules identified any concerns that need to be addressed by revoking, replacing or amending the amendment rules; and

  • the reasons for making the amendment rules remain valid.

  1. Copies of the rules may be inspected free of charge or purchased from the Electricity Commission, Level Seven, ASB Bank Tower, 2 Hunter Street, Wellington.

Notice of the Amendment of Exemption # 26

This notice of the amendment of an exemption is issued by the Electricity Commission (“Commission”), continued under subpart 1 of Part 15 of the Electricity Act 1992, pursuant to Regulation 194 (5) (d) of the Electricity Governance Regulations 2003 (“Regulations”) in favour of Transpower New Zealand Limited (“Transpower”), Contact Energy Limited (“Contact”), Meridian Energy Limited (“Meridian”), Genesis Power Limited (“Genesis”) and Alinta ENZ Limited (“Alinta”).

This is an amendment of the exemption granted under urgency, in reliance upon Regulation 194 (4), to Transpower, Contact, Meridian, Genesis and Alinta (Exemption # 26, published in the New Zealand Gazette, 16 September 2004, page 3010) (“original exemption”), from the requirement to comply with the following Electricity Governance Rules 2003 (“Rules”):

  1. Rule 11.5.2 of section IV of part C (event costs allocated to event causers).

Notice of the Amendment of an Exemption (“notice”)

Regulation 194 (5) (d) requires that the Commission must publish a notice in the New Zealand Gazette stating whether or not it decides to revoke, replace or amend an exemption granted under Regulation 194 (4) and explaining the reasons for that decision (or stating where copies of that explanation may be obtained).
