Land Transfer Act Notice

The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of an easement. The applicants claim the easement is redundant by reason of the circumstances set out below. I intend to remove the easement on the 18th day of February 2005, if no objections have been received before that date.

Applicants: Ian Gourdie and Colleen Natalie Gourdie, care of Hunter Ralfe, P.O. Box 49, Nelson.
Easement: Right to take water from the reservoir over part Section 12, District of Suburban North, comprised in certificate of title NL8B/1093, created by deed of easement 42632 (53/442) registered on the 1st day of November 1916.
Circumstances: The dominant tenements have become physically separated from the servient tenement as a result of subdivision shown on DP 12941 and the easement no longer serves the dominant tenement.

Notice of Application to Vary Terms of a Charitable Trust

In the High Court of New Zealand, Christchurch Registry

In the matter of the Charitable Trusts Act 1957, and in the matter of an application by the Selwyn House School Trust Board—Applicant:

Take notice that the trustees of the Selwyn House School Trust Board will apply to the High Court at Christchurch on the 2nd day of March 2005 at 9.30 a.m., for an order varying the terms of the Selwyn House School Trust Board deed dated the 12th day of July 1965.

The purpose of this application is to rewrite the Selwyn House School Trust Board deed in modern and simple language and to give the trustees administrative powers that will enable them to more effectively carry out the Trust’s purposes.

Further particulars of the application may be obtained from the office of the applicant’s solicitors, Lane Neave, Lawyers.

Any person desiring to oppose the scheme is required to give notice in writing of his/her intention to do so to:

(a) the Registrar of the High Court at Christchurch;
