Amendments to Schedule 9 to the principal notice

Clause 3

Repeal subclause (1) and substitute the following:

(1) The capacity that a secondary containment system is required to have to comply with
regulation 39 of the Hazardous Substances (Emergency Management) Regulations 2001 may
be reduced either–

 (a)  by the Authority upon application by any person and subject to such conditions as the
      Authority thinks fit; or

 (b)  in accordance with a code of practice approved by the Authority under section 79 of the
      Act for the purposes of this clause.
