Notice of Direction for Appointment of a Limited Statutory Manager for the Board of Trustees of William Colenso College (220)

Pursuant to section 78M of the Education Act 1989, I direct the Secretary for Education to appoint a limited statutory manager for the William Colenso College Board of Trustees because of risks to the operation of the school.

The following functions, powers and duties of the board are vested in the limited statutory manager:

● All functions, powers and duties of the board to manage financial operations (whether statutory or otherwise).

The limited statutory manager may also advise the board on the following:

● The application and operation of financial management systems.

This notice takes effect the day after the date of publication.

The Constitution of Te Mana Whakahaere (Council) of Te Wānanga o Aotearoa Te Kuratini o Ngā Waka

Pursuant to section 170 of the Education Act 1989, the Minister of Education gives the following notice.

Notice

1. This notice may be cited as the Te Mana Whakahaere (Council) of Te Wānanga o Aotearoa Te Kuratini o Ngā Waka Notice 2005.

2. The council of Te Wānanga o Aotearoa Te Kuratini o Ngā Waka shall be constituted as follows:

(a) Four members appointed by the Minister of Education.

(b) The Tumuaki (Chief Executive Officer) of Te Wānanga o Aotearoa.

(c) One person to be chosen from amongst the permanent members of the academic staff at the five Waikato / Maniapoto campuses and the head office of Te Wānanga o Aotearoa and elected by all permanent members of the academic staff of Te Wānanga o Aotearoa.

(d) One person to be chosen from amongst the permanent members of the general staff at the five Waikato/Maniapoto campuses and the head office of Te Wānanga o Aotearoa and elected by all permanent members of the general staff of Te Wānanga o Aotearoa.

(e) At least one but no more than two persons who are or who have been students of Te Wānanga o Aotearoa (the increase to two to be at the discretion of the council). The term of office for the student representative(s) will be one year and the representative(s) shall be elected from time to time by one campus of Te Wānanga o Aotearoa and the right to elect shall fall to each campus on a two year rotational basis in the order that the first letter of the campus name falls in the Māori alphabet.

(f) One person appointed by the Council of Te Wānanga o Aotearoa after consultation with the New Zealand Employers’ Federation.

(g) One person appointed by the Council of Te Wānanga o Aotearoa after consultation with the New Zealand Council of Trade Unions.

(h) One person appointed by the council as kaumātua of Te Mana Whakahaere (Council) of Te Wānanga o Aotearoa.

(i) At least five and no more than eight persons appointed by the council with regard to iwi representation, the specific needs of Te Wānanga o Aotearoa, its unique character, and the gender, ethnic and socio-economic composition of the community served by Te Wānanga o Aotearoa.

3. Subject to section 171 (3) of the Education Act 1989 and to clause 2 of this notice, the constitution of the council may include members by co-option.

4. Subject to section 173 of the Education Act 1989, the maximum term for any member, other than the chief executive officer, shall be five four-year terms.

5. This notice revokes the previous constitution as notified in the New Zealand Gazette, 2 September 1993, No. 129, page 2624.

6. This notice shall come into force on the day after the date of its notification in the New Zealand Gazette.

Private Schools Conditional Integration Act 1975

Mahurangi Christian School (Attendance Dues) Notice 2005

Pursuant to section 36 of the Private Schools Conditional Integration Act 1975, the Minister of Education hereby gives notice approving the charging of attendance dues at Mahurangi Christian School, Snells Beach.

Notice

1. This notice shall be cited as the Mahurangi Christian School (Attendance Dues) Notice 2005.

2. The proprietor of the above-named school may enter into an agreement with parents or other persons accepting responsibility for the education of a child at the above-named school requiring them to pay attendance dues.

3. The attendance dues payable in respect of any pupil shall be $844.00 (exclusive of G.S.T.) per annum, per pupil.

4. Attendance dues received by the proprietor shall be used for the purposes of paying for such improvements to, or for such capital works associated with, the buildings and associated facilities of the above-mentioned integrated school as may be required or approved by the Minister of Education, pursuant to section 40 (2) of the Private Schools Conditional Integration Act 1975, or for meeting debts, mortgages, liens, or other charges associated with any of the land and buildings that constitute the integrated school.
