Transit New Zealand (Maximum Speeds of Vehicles on State Highways)
Bylaw 2005/7
Pursuant to section 61(3) of the Transit New Zealand Act 1989 and clause 2.6 of the Land Transport Rule: Setting of Speed Limits 2003 (Rule 54001), Transit New Zealand hereby makes the following Bylaw:
1 Title and commencement—This Bylaw may be cited as the Transit New Zealand (Maximum Speeds of Vehicles on State Highways) Bylaw 2005/7 and shall come into force 28 days after its publication in the New Zealand Gazette.
2 Interpretation—In this bylaw:
“School days” means the days on which the schools adjacent to the sections of State highway described in Part B of Schedule 1 are open for instruction.
“State highway” means any road that is a State highway as defined in section 2 of the Transit New Zealand Act 1989, and includes a motorway as defined in section 2 of that Act.
“Variable speed limit” means the speed indicated on the last activated variable speed limit sign passed by a vehicle in the direction of travel of that vehicle on the section of State highway for which the maximum speed is set, and in the case of the variable speed limit on the sections of State highway described in Part B of Schedule 1, is a speed limit of 40 kilometres per hour on school days between the hours of 8.25 a.m. and 9.00 a.m., and 2.50 p.m. and 3.15 p.m., or any other time if, in the each case, the appropriate variable speed limit sign is activated.
“Variable speed limit sign” means a sign indicating a variable speed and which meets the criteria set out in or under the Traffic Regulations 1976 and the Land Transport Rule: Setting of Speed Limits 2003.
“Vehicle” has the same meaning as it has in section 2(1) of the Land Transport Act 1998.
3 Validation—All speed limits saved under section 4 of the Transport Amendment Act 1997 are hereby validated, other than those set under the Land Transport Rule: Setting of Speed Limits 2003.
4 Variable speeds of vehicles on specified sections of State highways—
(a) No person shall drive, ride or operate any vehicle at a speed exceeding the maximum variable speed limit shown on the relevant activated variable speed limit sign on the sections of State highway described in Schedule 1.
