Draft Determination on Application for Designated Access Service

On 4 November 2004, TelstraClear Limited applied, under section 20 of the Telecommunications Act 2001 ("the Act"), for a determination for designated access services ("application").

TelstraClear is seeking access to certain retail services offered by means of Telecom’s fixed telecommunications network, including private office networking.

Pursuant to section 27 (c) of the Act, the Commerce Commission gives public notice that it has made a draft determination on the application.

Submissions on the draft determination are due by close of business on 23 September 2005.

(i) Transpower has advised that it requires additional time to complete the proposed transmission pricing methodology this year, due to the limited staff resources available to complete the work required, and the potential for competing resource requirements to meet other regulatory requirements of both the Electricity and Commerce Commissions; and

(ii) it is conceivable that 90 days may also not be sufficient in future years, particularly if there are further changes to the Part F framework in the Rules which impact on the preparation of the transmission pricing methodology.

Notice of Confirmation of Electricity Governance Amendment Rules (No. 21) 2005 and Notice of Reasons for Decision

  1. Pursuant to section 172E (3) (b) of the Electricity Act 1992 ("Act"), I notify that the Electricity Governance Amendment Rules (No. 21) 2005 ("Amendment Rules"), which were made under urgency in accordance with section 172E (3) of the Act on 24 March 2005, will not be revoked, replaced or amended.

  2. Pursuant to section 172E (3) (b) of the Act, the reasons for my decision not to revoke, replace or amend the Amendment Rules are that:

    (a) no submissions received on the Amendment Rules identified any concerns that need to be addressed by revoking, replacing or amending the Amendment Rules; and

    (b) the reasons for making the Amendment Rules remain valid in that:

Notice of Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003: Electricity Governance Amendment Rules (No. 21) 2005

This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 ("Rules"), Electricity Governance Amendment Rules (No. 21) 2005, is issued by the Electricity Commission ("Commission"), established under the Electricity Act 1992 ("Act"), pursuant to section 172E (3) (a) (iii) of that Act.

Section 172E (3) (a) (iii) provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy, the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.

Recommendation

On 7 September 2005, the Commission made a recommendation to the Minister of Energy, pursuant to section 172E (3) (a) (ii) of the Act, that Rule 7.1 of section IV of Part F of the Rules (as amended by the Minister on 24 March 2005 in reliance on section 172E (3)) should not be revoked, replaced or amended.
