- New clause inserted—The programme is amended by
inserting, after clause P6, the following clause:
"P6A Treatment of foregone employment
(1) This clause applies if a person to whom the chief
executive is satisfied paragraphs (a) to (d) of clause
P6 (1) apply—
(a) has, since 1 February 2005, foregone
employment for the purpose, or the
predominant purpose, of undergoing
the operation to retrieve the kidney or liver
tissue; and
(b) left his or her employment for that purpose
between a date on or about the date
the person received notice that a date for the
operation had been allocated and the date
on which the operation took place; and
(c) was not in employment on the date of the
operation.
(2) The chief executive may, under clause P6 (1) (f),
treat the person as a person who will forego
income from employment during the person’s
convalescence from the operation."

Explanatory Note
This note is not part of the amendment, but is intended to
indicate its general effect.
This amendment to the Assistance to Live Organ Donors
Programme, which comes into effect on the day after it is
published in the New Zealand Gazette, allows a person who
foregoes employment for the purpose of undergoing an
operation to retrieve kidney or liver tissue to be treated as
a person who will forego income from employment during
the person’s convalescence from the operation.

for Schools Seeking Tertiary Funding of
$10,000.00 or Less in a Year and
Government Training Establishments
Under section 159N (4) of the Education Act 1989, the
Minister of Education gives the following notice.
Notice
-
This notice may be cited as the Education (Exemptions
from tertiary charter requirements for schools seeking
tertiary funding of $10,000.00 or less in a year and
government training establishments) Notice 2005. -
This notice applies from the date of its publication.
Introduction
All organisations that seek or receive funding from the
Tertiary Education Commission must have an approved
charter unless exempt from this requirement.
Exemption
The Minister exempts, under section 159N (4) of the
Education Act 1989, the following classes of organisation
from tertiary charter requirements:
● schools seeking tertiary funding of $10,000.00 or less in
a year; and
● government training establishments.

Final Determination on the Local and Cellular
Telephone Number Portability Designated
Multinetwork Services
On 26 March 2003, TelstraClear Limited, CallPlus
Limited, Compass Communications Limited, IHUG Limited
and WorldxChange Communications Limited applied,
under section 31 (b) of the Telecommunications Act 2001
("the Act"), for a determination concerning the formula for
allocating the cost of delivering the designated multinetwork
services of local and cellular telephone number portability.
On 24 December 2004, TelstraClear Limited, Telecom
New Zealand Limited and Vodafone New Zealand
Limited applied, under section 31 (a) of the Act, for a
determination concerning the functions and standards for
delivering the designated multinetwork services of local
and cellular telephone number portability.
Pursuant to section 39 (c) of the Act, the Commerce
Commission gives public notice that it has made a final
