Exemptions From Charter and Profile Requirements

Under sections 159B (2), 159N (4) and 159Y (3) of the
Education Act 1989, the Minister of Education and
the Tertiary Education Commission (TEC) give the
following notice.

Notice

1. This notice may be cited as the Education (Exemptions
   from Charter and Profile Requirements) Notice 2005.
2. This notice applies from the date of its publication.

Introduction

All organisations that seek or receive funding from the TEC
must have an approved charter and profile unless exempt
from the requirement to have a charter and profile.

Providers of Tertiary Education-Related Services

Organisations are defined under section 159B of the Education
Act 1989.

Before a body is eligible to have a charter considered for
approval by the Minister or to be exempted from the
requirement to have a charter, the body must first be
identified by the Minister as an organisation for the
purposes of Part 13A of the Education Act 1989, under
section 159B of the Education Act 1989.

For the purposes of Part 13A of the Education Act 1989,
the Associate Minister of Education (Tertiary Education)
