Notice of Intention to Take Land for Road—
Adjoining Tresillian Avenue, Nelson City

Notice is hereby given that Nelson City Council proposes to take, under the Public Works Act 1981, the land described in the Schedule to this notice (“the land”).

The land is required for road.

The council considers the taking of the land reasonably necessary to enable provision of a road link between the northern and southern parts of Tresillian Avenue, which link is provided for in the Nelson Resource Management Plan.

The owner of the land and those persons with a registered interest in it have been served with notice of the council’s intention to take the land and their right to object.

Every person having an estate or interest in the land intended to be taken may object to the taking of the land by sending a written objection to the Registrar, Environment Court, P.O. Box 2069, Christchurch, within 20 working days after the 14th day of July 2005.

If any objection is made in accordance with this notice, a public hearing will be heard with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Reserves Act 1977

Revocation of a Notice Relating to a Reserve and Issue of Fresh Notice

Under the Reserves Act 1977, and by reason of an error made in the notice described subsequently, the Conservator for the Northland Conservancy of the Department of Conservation revokes the notice headed Declaring Land to be Held for Conservation Purposes, dated the 16th day of June 2005 and published in the New Zealand Gazette, 23 June 2005, No. 94, page 2260, and issues the following notice as a fresh notice in its place:

Declaring Land to be Held for Conservation Purposes

Pursuant to section 7 (1A) of the Conservation Act 1987, the Conservator for the Northland Conservancy of the Department of Conservation declares that the land described in the Schedule is held for conservation purposes.

Classification of a Reserve

Under the Reserves Act 1977, the Conservator of the Nelson/Marlborough Conservancy of the Department of Conservation classifies the reserve described in the Schedule as a recreation reserve, subject to the provisions of section 17 of the Reserves Act 1977, and subject to the lease from the Crown to Landcorp Farming Limited under the Land Act 1948, dated 11 May 2005, and excluding all the marginal strips created by the granting of the said lease and subject to lease described in Computer Freehold Register MB5D/1126 (Marlborough Registry) and deeds of easement in gross described in Computer Freehold Register MB5D/1127 (Marlborough Registry) and Computer Freehold Register CB46C/320 (Canterbury Registry).
