The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of the an easement. The applicant claims the easement is redundant by reason of the circumstances set out below. I intend to remove the easement on the 2nd day of September 2004, if no objections have been received before that date.

Circumstances: Right of way and rights to drain water and sewage marked "B", "E" and "F" on DP 43347, specified in easement certificates 95231.4 and 288460.1 have become redundant insofar as it is over Lot 1, DP 43347 (Computer Register CB21F/1096), appurtenant to Lot 1, DP 75077 (Computer Register CB43B/429).

Drain water marked "C", "D" and "F" and drain sewage marked "F" and "G" on DP 38213, specified in easement certificate 95231.4 have become redundant insofar as it is over Lots 4-5, DP 38213 (Computer Register CB17A/51, CB17A/145-146), appurtenant to Lot 1, DP 75077 (Computer Register CB43B/429).

Hawkes Bay Childrens Home Trust Scheme

Notice of Application for Approval of a Scheme

Pursuant to Part III of the Charitable Trusts Act 1957

Take notice that on Monday, the 30th day of August 2004, the trustees of the Hawkes Bay Childrens Home, Birthright (Napier) Incorporated and Familycare (HB) Incorporated will apply to the High Court at Napier for orders approving a scheme defining the objects and prescribing the rules for administration of the Hawkes Bay Childrens Holding Trust and Birthright (HB) Child and Family Care Trust.

1. The applicant seeks to amalgamate the objects and powers of each trust, vest the assets in a holding trust (Hawkes Bay Childrens Holding Trust) and make provision for their administration through a new trust Birthright (HB) Child and Family Care Trust.

2. A copy of the proposed scheme, originating application and supporting affidavits may be inspected at the offices of Sainsbury Logan & Williams, Solicitors, corner of Tennyson Street and Cathedral Lane, Napier, during the hours of business, 8.30 a.m. to 5.00 p.m. Monday to Friday.

3. Any person desiring to oppose the scheme should give written notice of his or her intention to do so no less than seven clear days prior to the hearing to:

3.1 the Registrar of the High Court at Napier; and

3.2 Her Majesty’s Attorney-General, care of Crown Law Office, P.O. Box 2858, Wellington (Attention: M. A. Soper); and
