Land Transfer Act Notice

I hereby give notice of an application lodged with me for the issue of a certificate of title to the below-named applicants, under section 19 of the Land Transfer Act 1952, for the land described below. Such certificate of title may be issued unless a caveat forbidding the same is lodged on or before the 25th day of March 2004.

Application No.: 5843065.1.

Applicants: Geoffrey Graeme Rountree and Sandra Kay Rountree of Christchurch.

Description: For an estate in fee simple in 4100 square metres, more or less, being part of Lot 4 on a plan lodged for deposit in the Canterbury Land Registry under 304370, being part Rural Section 1749 BM109, which is part of the land remaining in Deeds Index, Volume 20D, folio 587.

Circumstances: Such land being part of the land granted to Henry Harold de Bourbel and Joseph Birch, of Rangiora, under grant 10129 on the 20th day of September 1860, who are recorded as being the documentary owners thereof.

Notice is hereby given that the applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of an easement. The applicant claims the easement is redundant by reason of the circumstances set out below. I intend to remove the easement on the 25th day of February 2004, if no objections have been received before that date.

Easement: Right to convey water over part marked "F" on Section 66, Block XII, Lower Hawea Survey District, comprised in Computer Register 1516 in favour of Lot 2, D.P. 300141, Computer Register 1517 created by transfer 670229.4, registered on the 22nd day of December 1986 at 2.09 p.m., and right to convey water over part marked "B" on Section 87, Block XII, Lower Hawea Survey District, comprised in Computer Register OT9B/1045 in favour of Lot 2, D.P. 300141, Computer Register 1517 created by transfer 670229.5, registered on the 22nd day of December 1986 at 2.09 p.m.

Circumstances: Separation of the dominant tenement from the servient tenement caused by the subdivision shown on D.P. 300141.
