Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Trevor Knowles, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the Schedule to this notice is to be acquired for motorway purposes and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

Pursuant to section 114 of the Public Works Act 1981 and to a delegation from the Minister for Land Information, Trevor Knowles, Land Information New Zealand, declares the land described in the Schedule to this notice to be road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, becomes road, limited access road and State highway and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.

Land and Easement Acquired for Water Supply Purposes—No. 1 Road, Western Bay of Plenty District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Trevor Knowles, Land Information New Zealand:

(a) Pursuant to section 20, declares that, an agreement to that effect having been entered into, the land described in the First Schedule to this notice is hereby acquired for water supply purposes and vested in the Western Bay of Plenty District Council on the date of publication of this notice in the New Zealand Gazette; and

(b) Pursuant to sections 20 and 28, declares that, an agreement to that effect having been entered into, a right of way, and a right to convey water and electricity in perpetuity, as described in the Third Schedule to this notice is hereby acquired for water supply purposes over the land described in the Second Schedule to this notice, and vested in the Western Bay of Plenty District Council on the date of publication of this notice in the New Zealand Gazette.

Description of Easements

Right of way along with the rights and powers set out in paragraphs 6 and 10 to 14 inclusive of Schedule 4 of the Land Transfer Regulations 2002.

Right to convey water along with the rights and powers set out in paragraphs 3 and 10 to 14 inclusive of Schedule 4 of the Land Transfer Regulations 2002, except that the words "in common with the grantor (as defined in the Fourth Schedule) and other persons to whom the grantor may grant similar rights" in paragraph 3 (i) shall be deleted.

Right to convey electricity along with the rights and powers set out in paragraphs 7 and 10 to 14 inclusive of Schedule 4 of the Land Transfer Regulations 2002, except that the words "as agreed by the grantor at the time of installation of the facility in paragraph 7 (iii)" shall be deleted.
