  1. The exemption shall expire on 31 October 2004.

  2. The system operator must pay to a generator any constrained on amount calculated pursuant to Rule 5.4, less any constrained on amount payable for frequency keeping provided in a trading period for which it has issued a dispatch instruction to:

    (a) cease providing the frequency keeping at any time less than 3 minutes after the beginning of the relevant trading period; or

    (b) commence providing the frequency keeping at any time less than 3 minutes before the end of the relevant trading period.

Board’s Reasons for Granting the Exemption Contained in this Notice

The reasons for granting the exemption are as follows:

(a) The issue faced by Transpower is due to the transition from NZEM to the Rules and can be addressed through granting an exemption.

(b) The Commission is unable to identify any participants who would be unduly affected by the grant of the exemption.

(c) Granting the exemption will allow time for the Commission to investigate a rule change or other mitigation measures which appropriately address the issue.

Date Upon Which the Exemption Becomes Effective

Pursuant to Regulation 195, the date upon which the exemption contained in this Exemption Notice takes effect is 3 June 2004.

Pursuant to Regulation 194 (5) (c), the Commission will publicise the exemption on the Commission’s web site.

Energy Efficiency and Conservation Authority

● To introduce minimum energy performance standards for distribution transformers as defined in AS 2374 (oil filled) and AS 2375 (dry type), for introduction on 1 October 2004.

● To introduce minimum energy performance standards for single phase air conditioners as defined in AS/NZS 3823:2003, for introduction on 1 October 2004.\n
● To increase the stringency of minimum energy performance standards for single phase and three phase air conditioners as defined in AS/NZS 3823:2003 by October 2007.

● To increase the stringency of minimum energy performance standards for household refrigerators and freezers as defined in AS/NZS 4474.2-2001 on 1 January 2005.

The proposed Regulations will establish, or increase the stringency of, the minimum energy performance standards of these products to ensure alignment of standards with Australia, in accordance with the Trans-Tasman Mutual Recognition Arrangement, and to ensure the cost effective improvement of energy efficiency performance of these product classes.

Energy Efficiency and Conservation Act 2000

Proposal to Make Regulations for Mandatory Energy Performance Standards

Pursuant to section 36 of the Energy Efficiency and Conservation Act 2000, the Minister of Energy gives the following notice.

The Minister of Energy proposes to recommend to Cabinet that Schedule 1 of the Energy Efficiency (Energy Using Products) Regulations 2002 be amended to introduce mandatory energy performance standards (MEPS) for a range of energy-using products, and to increase the stringency of MEPS for a number of other energy-using products.

A period of public consultation on the proposed Regulations is also notified and details are given below.

The proposed amendments are as follows:

● To introduce minimum energy performance standards for commercial refrigeration equipment as defined in AS1731:2003, for introduction on 1 October 2004.
