First Schedule hereto and the land described in the Third
Schedule hereto.

  1. The councils shall at their cost erect and maintain a
    boundary fence between the land described in the
    First Schedule hereto and the land described in the Third
    Schedule hereto.

  2. This covenant runs with the land described in the
    First Schedule and binds the councils and all subsequent
    owners of the land described in the First Schedule hereto.

  3. This covenant shall be for the benefit of and appurtenant
    to the land described in the Third Schedule hereto.

Third Schedule
Land for Which the Benefit of a Fencing Covenant is
Held Appurtenant

Part Lot 3, DP S10685, being part of the balance of the land
contained in Computer Register SA71A/57.

Road Realignment—State Highway No. 3,
Mokau Road, New Plymouth District

Pursuant to the Public Works Act 1981, and to a delegation
from the Minister for Land Information, Ronald Alistair
Jolly, Land Information New Zealand:

(a) Pursuant to section 114, declares the land described
in the First Schedule to this notice to be road which,
pursuant to section 60 (2) of the Transit New Zealand Act
1989, shall form part of State Highway No. 3 and shall vest
in the Crown on the date of publication of this notice in the
New Zealand Gazette.

(b) Pursuant to sections 116, 117 and 120 (3), declares
the portions of road described in the Second Schedule to
this notice to be stopped and shall be amalgamated with
the land in Computer Register G2/486, subject to mortgages
5625045.3 and 5625045.4.

(c) Pursuant to section 119, declares the severance
described in the Third Schedule to this notice to be taken
and shall be amalgamated with the land in Computer
Register G2/486, subject to mortgages 5625045.3 and
5625045.4.
