Mental Health (Compulsory Assessment and Treatment) Act 1992

Mental Health (Compulsory Assessment and Treatment) Act Notice 2004—Appointment of Directors of Area Mental Health Services

Pursuant to section 92 of the Mental Health (Compulsory Assessment and Treatment) Act 1992, I, Karen Olive Poutasi, Director-General of Health, give the following notice.

Notice

  1. This notice shall be read together with the Mental Health (Compulsory Assessment and Treatment) Act Notice 2000 —Appointment of Directors of Area Mental Health Services (“the principal notice”)*.

  2. The Schedule to the principal notice is amended in respect of “Area 2—Auckland” by omitting the name and title Nick Argyle, medical practitioner, of Auckland and substituting the name and title Debbie Antcliff, medical practitioner, of Auckland.

Notice of Public Ruling

  1. This is a notice of a public ruling made under section 91D of the Tax Administration Act 1994.

  2. Public ruling BR Pub 04/04 entitled “Land sales—Whether income tax exemptions for farm land apply to non-natural persons” was issued on 10 May 2004. The ruling’s subject matter was originally contained in BR Pub 99/04, which applied from 1 June 1999 to 31 May 2004. BR Pub 04/04 applies from 1 June 2004 for an indefinite period. It will appear in Inland Revenue’s Tax Information Bulletin, Vol. 16, No. 4 of May 2004.

  3. A copy of the ruling may be obtained by writing to the Manager, Field Liaison & Communication (Adjudication & Rulings), National Office, Inland Revenue, P.O. Box 2198, Wellington.

Misuse of Drugs Act 1975

Revocation of Prohibition From Prescribing Controlled Drugs

Pursuant to section 23 (3) of the Misuse of Drugs Act 1975, I, Annette King, Minister of Health, hereby revoke the notice issued on 30 October 1989 and published in the New Zealand Gazette, 9 November 1989, page 5672, that prohibits the prescribing of controlled drugs by Dr Saba La Hood, medical practitioner of Wellington.

Reappointments to the National Ethics Committee on Assisted Human Reproduction

Pursuant to sections 11 and 16 (3) of the New Zealand Public Health and Disability Act 2000, I reappoint Dr Anne Robertson Dr Beverley Lawton to the National Ethics Committee on Assisted Human Reproduction for a three-year term commencing from the date of this notification.

Judicature Act 1908

Court of Appeal Procedures Adopted

Pursuant to sections 58C (1) and 58E (1) of the Judicature Act 1908, those Judges of the Court of Appeal holding office under section 57 (2) of the Judicature Act 1908, have adopted the following procedures.

Assignment of Judges to the Divisions of the Court of Appeal

The Judges of the Court of Appeal have adopted the following procedure for assignment of Judges to act as members of a criminal or civil division of the Court:

● The Court will prepare periodically a forward planning programme covering the anticipated sittings of the divisions.

● The President, acting President or nominee will determine which appeals are appropriate for hearing by a division comprising three members of the Court.

● Assignment to particular appeals or a particular appeal will be by the President, the acting President or nominee who, where appropriate, will consult with other members of the Court. The assignment of High Court Judges to divisions of the Court will be:

(a) consistent with their eligibility through nomination by the Chief Justice in terms of sections 58A and 58B of the Judicature Act 1908; and

(b) with the concurrence of the Chief Justice and the Chief High Court Judge pursuant to subsection (3) of section 58C of the Judicature Act 1908.

● In assigning Judges to cases, the President, acting President or nominee shall take into account the following:

(a) The forward planning programme and the availability of Judges;

(b) The equitable sharing of work among the Judges;
