Exemption From Specific Equipment Requirement

Pursuant to Regulation 16A (2) of the Heavy Motor Vehicle Regulations 1974 and Regulation 1 (7) (a) of the Goods Service Vehicle (Constructional) Regulations 1936, and pursuant to the powers delegated to me by the Director of Land Transport Safety, I, Laszlo Andras Hidvegi, Senior Engineer Safer Vehicles Policy, hereby exempt the vehicles specified in Schedule 1 of this notice from the requirement in Schedule 2, subject to the conditions specified in Schedule 3.

Schedule 1

Vehicle details

VIN Range of Vehicles Exempted: WDB930 to WDB935 inclusive

Schedule 2

  1. Regulation 16A (1) (b) of the Heavy Motor Vehicle Regulations 1974.
  2. Requirement to be fitted with audible low air pressure warning device required in Regulation 2 (4) (b) (ii) of the Goods Service Vehicle (Constructional) Regulations 1936.

Schedule 3

(i) It must be demonstrated that the vehicles comply with the requirements of UN/ECE Regulation No. 13, 09 series of amendments, supplement 2 (E/ECE/324-E/ECE/TRANS/505.Rev.1/Add.12/Rev.3/Amend.2) "Uniform provisions concerning the approval of vehicles of categories "M", "N" and "O" with regard to braking" or any later version of this Regulation.

(ii) The vehicle must be fitted with a "Telligent" electronic brake control system, installed by the manufacturer of the vehicle.

(iii) The two factory fitted independent visual warning devices of the vehicles to warn the drivers if the air pressure in any of the service brake reservoirs drops below 6.6 bar, or if the air pressure in the parking brake system or trailer brake system reservoir drops below 5.3 bar, must function correctly.

(iv) The Telligent electronic brake control system must be operational within the tolerances specified by the vehicle manufacturer.

(v) The brake system of the vehicle must not be modified in any way.

(vi) The brake system of the vehicle must be maintained as specified by the vehicle manufacturer.

(vii) Any components, including but not restricted to valves, sensors, relays, fittings and brake friction materials, that are fitted to the brake system of the vehicle during maintenance or repair, must be supplied or approved by the vehicle manufacturer.

(viii) The vehicles must continue to comply with the requirements of the Regulation in clause (i) and the requirement in clause (ii) to (v).

(ix) A Statement of Compliance with the requirements in clauses (i) to (v) must be issued for each exempted vehicle by the authorised agent of the vehicle manufacturer and it must require continuous compliance with the conditions of this exemption.

(x) The Statement of Compliance in clause (ix) is sufficient means of verification of compliance with a standard, alternative to the one required in Regulation 16A (1) (b) of the Heavy Motor Vehicle Regulations 1974.

(xi) A copy of the Statement of Compliance in clause (ix), together with every relevant supporting information and documents, must be kept by the person who issued it, and one copy of the Statement of Compliance must be provided to the registration organisation and to the operator of the vehicle.

(xii) This exemption may be revoked at any time.

Amendment to the Criteria for Approval as a Listed Provider

Pursuant to section 71 (1) of the Legal Services Act 2000, the Legal Services Agency developed and adopted Criteria for Approval as a Listed Provider in February 2003 (published in the New Zealand Gazette, 16 January 2003, page 174).

The agency now gives notice of an amendment to the criteria under "Contract for Services" to include listed providers employed by the agency.

This amendment will be effective from 3 May 2004.

The Criteria for Approval as a Listed Provider, the agency web site and the provider manual will be amended to reflect the change.
