(b) adding the following words as new paragraph (g) in
Rule 4.15:

"In the 15 minutes prior to the scheduled start time
of the Race concerned, a bet on the Race can only
be cancelled within 60 seconds of the bet being
accepted by the Board."

This Rule comes into force on 26 April 2004.
Copies of the Betting Rules may be inspected free of charge
at TAB offices or may be purchased from the New Zealand
Racing Board.

Nurses Act 1977

Order of the Nursing Council in Disciplinary Session

in Respect of a Registered Comprehensive Nurse

Pursuant to sections 42 (1) (b), 42 (2) (d), 42 (3) and 48A of
the Nurses Act 1977, the Nursing Council of New Zealand
(“the council”), in a decision dated 23 October 2003,
ordered that a registered comprehensive nurse be censured.

The council also ordered that the nurse pay $9,400.00 (being
30%) of the actual costs and expenses of and incidental to
the investigation by the preliminary proceedings committee
and inquiry by the council, and that a notice stating the
effect of the orders be published in the New Zealand
Gazette, Kai Tiaki: Nursing New Zealand, the council’s
newsletter and released to accredited members of the media,
upon request, with all identifying features of the case
suppressed.\n

Order of the Nursing Council in Disciplinary Session

in Respect of Ma Christy Labadlabad Bacaling
(also commonly known as Christy Ibarra),
Registered Comprehensive Nurse

Pursuant to sections 42 (1) (b), 42 (2) (a), 42 (3), 42 (9)
and 48A of the Nurses Act 1977, the Nursing Council
of New Zealand (“the council”), in a decision dated
12 November 2003, ordered that the name Ma Christy
Labadlabad Bacaling, registered comprehensive nurse, be
removed from the Register of Comprehensive Nurses.

In exercising its disciplinary powers, the council declined to
fix a time after which Ma Christy Labadlabad Bacaling
could apply for reinstatement to the Register.

The council also ordered that Ma Christy Labadlabad
Bacaling pay $5,190.00 (being 40%) of the actual costs
and expenses of and incidental to the investigation by
the preliminary proceedings committee and inquiry by the
council, and that a notice stating the effect of the orders be
published in the New Zealand Gazette, Kai Tiaki: Nursing
New Zealand, the council’s newsletter and released to
accredited members of the media, upon request, with
suppression of the name of the patient and institution.

Order of the Nursing Council in Disciplinary Session

in Respect of an Enrolled Nurse

Pursuant to sections 42 (1) (a), 42 (2) (b), 42 (3) and 48A of
the Nurses Act 1977, the Nursing Council of New Zealand
(“the council”), in a decision dated 15 November 2003,
ordered that an enrolled nurse be suspended from practice
for a period of six months following conviction in the
New Plymouth District Court on 2 April 2001.

The charges included theft by a person holding power of
attorney (sections 223 and 227 (A) of the Crimes Act 1961)
and 17 counts of using documentation for pecuniary
advantage (section 229 (A) (b)).

The nurse was sentenced to four months’ periodic detention,
limited to light duties, and ordered by the Court to pay
reparation of $1,587.22 to the victim and $1,220.62 to the
police.

In exercising its disciplinary powers, the council also
ordered that the nurse pay $580.00 towards the costs and
expenses of and incidental to the council inquiry, and that
a notice stating the effect of the orders be published in
the New Zealand Gazette, Kai Tiaki: Nursing New Zealand,
the Nursing Review, the council’s newsletter and made
available to accredited members of the media, upon request,
with suppression of all identifying details of the case.

in Respect of a Registered General and
Obstetric Nurse

Pursuant to sections 42 (1) (b), 42 (2) (ba), 42 (3) and
48A of the Nurses Act 1977, the Nursing Council of
New Zealand (“the council”), in a decision dated
23 December 2003, ordered that conditions be imposed
on the practice of a registered general and obstetric nurse,
to be met within six months of the date of the decision.

The council also ordered that the nurse pay $1,845.00 (being
25%) of the actual costs and expenses of and incidental to
the investigation by the preliminary proceedings committee
and inquiry by the council, and that a notice stating the
effect of the orders be published in the New Zealand
Gazette, Kai Tiaki: Nursing New Zealand, the council’s
newsletter and released to accredited members of the media,
with all identifying features of the case suppressed.

Comprehensive Nurse

Pursuant to sections 42 (1) (b), 42 (2) (a), 42 (3) and 48A of
the Nurses Act 1977, the Nursing Council of New Zealand
(“the council”), in a decision dated 23 December 2003,
ordered that the name James John Dunn, registered
comprehensive nurse, be removed from the Register
of comprehensive nurses.

The council also ordered that James John Dunn could
reapply for reinstatement to the Register after a period of
