Land Transfer Act Notice

I hereby give notice of an application lodged with me for the issue of certificates of title to the below-named applicants,
pursuant to Part IVA of the Land Transfer Act 1952, for the land described below.
Such certificates of title may be issued unless caveat forbidding that is lodged with me on or before Friday, the 30th day of April 2004.

Application No.: 5895644.

Applicants: Julie Honor Garnham (one-quarter share) on behalf of herself and David Frank Scott and Pauline Lynaire Scott (one-quarter share), Paul Michael Scarrott (one-quarter share), and Kerran Alan Deihl and Denise Jane Deihl (one-quarter share).

Description of Land: An estate in fee simple in 472 square metres, more or less, being part marked "Right of Way" on Deposited Plan 2703 and being the land in certificate of title HB88/124 Interim (Hawkeโ€™s Bay Land Registry). The land will remain subject to rights of way created by transfers 41660, 42655, 72000, 72003 and 72993. The new title for the application land will cease to be Interim.

Circumstances: The registered proprietor of the above land is William Jones of Napier, settler, who became the registered proprietor in 1948. The land adjoins Lots 8, 9 and 10, D.P. 2703, and Lot 1, D.P. 25871 (formerly Lot 11, D.P. 2703) and provides access for the last four mentioned parcels of land to France Road.

Land Transfer Act Notice

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of the easements. The applicant claims the easements are redundant by reason of the circumstances set out below. I intend to remove the easements on the 13th day of April 2004, if no objections have been received before that date.

Applicant: Laing Contractors Limited.

Easements: Right to drain sewage; marked "Z-F" on D.P. 46071, specified in easement certificate 444643.4 has become redundant as it is over Lots 31 and 34, D.P. 78158 (certificates of title CB44D/891 and CB44D/893) appurtenant to Lots 1-4, D.P. 325033 (certificates of title 100941-100944). Water race easement in transfer 86338 has become redundant as it is over part Lot 1, D.P. 44817 (certificate of title CB24A/757), appurtenant to Lots 1-4, D.P. 325033 (certificates of title 100941-100944).

Circumstances: Redundant by long term disuse.

Joint Family Homes Act Notice

The undermentioned persons have applied under the Joint Family Homes Act 1964 to register as a joint family home the land described below.

The land will be registered accordingly unless a caveat forbidding the granting of the application is lodged with me under that Act at the Land Information New Zealand Office at Wellington before the 14th day of June 2004, by some person claiming either to be a creditor of the applicants or to have some estate or interest in the said land.
