Fisheries (South Island Customary Fishing) Regulations 1999

Fisheries (South Island Customary Fishing) Notice (No. 53) 2004 (No. F277)

Pursuant to Regulations 10 and 23 of the Fisheries (South Island Customary Fishing) Regulations 1999, and acting under delegated authority, the Associate Minister of Fisheries hereby gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 53) 2004.

(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) “customary food gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.

(b) “Tāngata Tiaki/Kaitiaki” means the person or persons appointed under Regulations 9 and 21 of the Fisheries (South Island Customary Fishing) Regulations 1998 as Tāngata Tiaki/Kaitiaki for the area/rohe moana and the mataitai reserve, as described in clauses 2 (c) and 2 (d).

(c) “the area/rohe moana” means the area/rohe moana from the Heathcote River outlet to Adderley Head, including the whole of the Lyttleton Harbour.

(d) “the mataitai reserve” means a traditional fishing ground at Rapaki Bay encompassing those waters which lie inside straight lines drawn from the Cass Bay-Church Reserve boundary (at 43° 36.78′ S and 172° 41.6′ E) to Windy Point (at 43° 36.895′ S and 172° 40.4′ E) to the 1C Taukahara boundary (43° 36.951′ S and 172° 40.95′ E); then along the mean high water mark to the point of commencement.

  1. Cancellation of a Tāngata Tiaki/Kaitiaki—Te Hapū o Ngāti Wheke Rapaki, being the tangata whenua who nominated Wiremu Gillies as Tāngata Tiaki/Kaitiaki for the area/rohe moana and the mataitai reserve, have requested in writing the cancellation of the appointment of Wiremu Gillies as Tāngata Tiaki/Kaitiaki.

  2. Cancellation of Appointment—The Associate Minister of Fisheries hereby confirms the cancellation of the appointment of Wiremu Gillies as Tāngata Tiaki/Kaitiaki for managing customary food gathering for the area/rohe moana and the mataitai reserve.

(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) “customary food gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.

(b) “Tāngata Tiaki/Kaitiaki” means the person or persons appointed under Regulation 9 or 10 of the Fisheries (South Island Customary Fishing) Regulations 1999 as Tāngata Tiaki/Kaitiaki for a general customary food gathering area/rohe moana.

(c) “area/rohe moana” means the area from Waihemo to Purehurehure, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, being the 200 mile limit, and inland to the boundaries defined for Kati Huirapa ki Puketeraki under the First Schedule of Te Runanga o Ngai Tahu Act 1996.

  1. Cancellation of Tāngata Tiaki/Kaitiaki—Kāti Huirapa Rūnaka ki Puketeraki, being the Tāngata Whenua who nominated William Rangi Hawea Ellison, Thomas Raymond Duff, and Kuao Robert Duff as Tāngata Tiaki/Kaitiaki for the area/rohe moana, have requested in writing the cancellation of appointment of William Rangi Hawea Ellison, Thomas Raymond Duff, and Kuao Robert Duff as Tāngata Tiaki/Kaitiaki for the area/rohe moana.

  2. Cancellation of Appointment—The Associate Minister of Fisheries hereby confirms the cancellation of William Rangi Hawea Ellison, Thomas Raymond Duff, and Kuao Robert Duff as Tāngata Tiaki/Kaitiaki for managing customary food gathering for the area/rohe moana.

  3. Nomination of Tāngata Tiaki/Kaitiaki—Kāti Huirapa Rūnaka ki Puketeraki, being the Tāngata Whenua holding manawhenua manamoana over the area/rohe moana, have nominated Khyla Russell and Brendon Flack as Tāngata Tiaki/Kaitiaki for the area/rohe moana.

  4. Appointment of Tāngata Tiaki/Kaitiaki—The Associate Minister of Fisheries hereby confirms the appointment of Khyla Russell and Brendon Flack as Tāngata Tiaki/Kaitiaki for managing customary food gathering for the area/rohe moana. The appointment is for a term of five years commencing the day this notice comes into effect.

  5. Power to authorise taking of fisheries resources for customary food gathering—The Tāngata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Acts 1983 and 1996 for customary food gathering purposes from within the whole or any part of the area/rohe moana.

No customary food gathering of fisheries resources may take place in the area/rohe moana without authorisation of a Tāngata Tiaki/Kaitiaki.
