recommendation is minor), on 8 November 2004.
Section 172F (3) provides that the Commission is not
required to comply with section 172F (1) (assessment) if it is
satisfied that the effect of the recommendation is minor and
will not adversely affect the interests of any person in a
substantial way.

Accordingly no such assessment has been carried out at this
stage.

Recommended Amendment to the Rules
The recommended amendment to Rule 3.3 of Code of
Practice D3, Schedule D1 of Part D, is the inclusion of an
additional sentence that requires all conductors connecting
measuring transformers to other components in a metering
installation to be clearly and permanently identified.

This is to ensure the accuracy of metering.

Notice of Making of Electricity Governance Amendment Rules (No. 11) 2004 and Notice of Reasons for Decision

  1. Pursuant to section 172I of the Electricity Act 1992,
    I notify the amendment of the Electricity Governance Rules
    2003 (“the Rules”) under section 172H of the Electricity
    Act 1992.

  2. The empowering provisions for the electricity governance
    regulations in relation to which the Rules are made are
    sections 172D (1) (1) (b) of the Electricity Act 1992.

  3. A brief description of the nature of the amendment is as
    follows:

The amendment to Rule 5.2 of Code of Practice D3,
Schedule D1 of Part D, inserts an additional note that
outlines that the certification validity periods do not need
to be shortened if meters of a higher accuracy class are
used.

  1. The amendment is made in reliance on section 172F (3)
    of the Electricity Act 1992.

  2. Pursuant to section 172Z (4) of the Electricity Act 1992,
    the reasons for my decision to amend the Rules are that:

  • the Rule currently has the unintentional effect of
    discouraging the use of higher accuracy meters being
    installed due to the illogical requirement to recertify
    within a shorter period of time; and

  • the amendment to the Rule will encourage the use of a
    greater number of higher accuracy meters, therefore the
    Rule change better ensures the accuracy of metering.

  1. This Rule comes into force on 16 December 2004.

  2. Copies of the Rules may be inspected free of charge or
    purchased from the Electricity Commission, Level Seven,
    ASB Bank Tower, 2 Hunter Street, Wellington.

To address concerns around not having an applied
standard in colour coded wiring for conductor identity in
the Rules, the following amendment to the Rules is
made:

a. Amend Rule 3.3 of Part D, Schedule D1, Code of
Practice D3, by including an additional sentence
that requires all conductors connecting measuring
transformers to other components in new metering
installations be clearly and permanently identified.

  1. This amendment is made in reliance on section 172F (3)
    of the Electricity Act 1992.

  2. Pursuant to section 172Z (4) of the Electricity Act 1992,
    the reason for my decision to amend the Rule is that it better
    ensures the accuracy of metering.

  3. This Rule comes into force on 16 December 2004.

Notice of the Grant of an Exemption # 3

This notice of the grant of an exemption is issued by the
Electricity Commission (“Commission”), continued under
subpart 1 of Part 15 of the Electricity Act 1992, pursuant to
Regulation 194 of the Electricity Governance Regulations
2003 (“Regulations”) in favour of Norske Skog Tasman
Limited (“Norske Skog”).

This exemption is being granted under urgency in reliance
on Regulation 194 (4).

Notice of the Grant of an Exemption (“notice”)
Regulation 194 (2) requires that the exemption and the
Commission’s reasons for granting it are notified in
the New Zealand Gazette as soon as practicable after being
granted.

Subject to the terms and conditions imposed upon Norske
Skog in respect of any exemption contained within this
notice, the Commission hereby notifies it grants an
exemption to Norske Skog from the requirement to comply
with the following Electricity Governance Rules 2003
(“Rules”):

  • Rules 6.1, 6.4 and 6.5 of Schedule C3 of technical code
    B of part C.

Terms and Conditions of the Grant of the Exemption
Pursuant to Regulation 194 (1), the Commission may, in its
discretion and upon the terms and conditions (if any) that
it thinks fit, exempt any participant, or class of participants,
from compliance with all or any of the Rules.

The Commission must include an expiry date pursuant to
Regulation 194 (5) (b).
