Under the Land Act 1948, the Conservator for the Otago Conservancy of the Department of Conservation sets apart the land described in the Schedule as a scenic reserve, subject to the provisions of section 19 (1) (a) of the Reserves Act 1977.

Ngāi Tahu Claims Settlement Act 1998

Reserves Act 1977

Cancellation of the Vesting in the Dunedin City Council of Part of a Reserve, Classification of Reserve and Vesting in the Waikouaiti Māori Trust Board

Under the Reserves Act 1977 and section 408 of the Ngāi Tahu Claims Settlement Act 1998, and pursuant to an agreement between the Dunedin City Council, the Waikouaiti Māori Foreshore Trust Board and the Minister of Conservation dated 1 October 2004, the Conservator for the Otago Conservancy of the Department of Conservation cancels the vesting in the Dunedin City Council over that part of the reserve described in the Schedule, and further classifies the land described in the Schedule as a recreation reserve and vests the reserve in the Waikouaiti Māori Foreshore Trust Board in trust for that purpose.
