  1. Appointment of Tāngata Kaitiaki—The Associate
    Minister of Fisheries (acting pursuant to a delegated
    authority) hereby confirms the appointment of Riko
    Ahomiro, Colin Bidois, Alf Borrell, Peter Borrell, Wiripo
    Brown, Hori Deans, Brian Dickson, Irahapeti Betty
    Dickson, Jock Hohepa Ellis, Pet Gardiner, Rangi Gear,
    Marshall Grey, Judy Harpur, Kevin Haua, Neil Hirama,
    Rahiri Johnathan, Pio Kawe, Rawiri Kuka, Taeawa Kuka,
    Te Maki Ladbrook, Michael Manihera, Whiti McLeod,
    Eddie Ngatai, Patrick Nicholas, Peter Nicholas, John Nuku,
    Waraki Paki, Brian Palmer, Wally Papa, Anthony Paraire,
    Tu Piahana, Murray Pio, Jake Poka, Te Hiringa Rawson,

    for managing customary food gathering within the area/rohe
    moana.

(c) Any reference to “Kaitiaki” means the person or
persons appointed under Regulation 9 or 10 of
the Fisheries (Kaimoana Customary Fishing)
Regulations 1998 for the management of customary
food gathering within the area/rohe moana.

(d) Any reference to “area/rohe moana” means one or
other of the following two areas:

(i) Firstly, an area described by a line beginning on
the coastline at Poroporo (40°27.0′S 176°37.5′E)
east to the 12 nautical mile limit to reference
point (40°27.0′S 176°53.0′E), then south-west
along the 12 nautical mile limit to reference
point (40°52.0′S 176°30.5′E), then west to
Mataikona (40°47.0′S 176°16.0′E) and then
north-east following the coastline to the point
of commencement and;

(ii) secondly, an area described by a line beginning
on the coastline at Owahanga (40°41.0′S
176°21.5′E) then perpendicular to the coastline
out to the 12 nautical mile limit (40°47.5′S
176°34.1′E), then south along the 12 nautical
mile limit to reference point (40°57.5′S
176°29.9′E), then west towards Whareama to
the coastline (40°57.5′S 176°09.0′E) and then
north-east following the coastline to the point
of commencement.\n
4. Confirmation of tāngata whenua—Ngāiterangi, Ngāti
Ranginui and Ngāti Pukenga, as represented by the Tauranga
Moana Iwi Customary Fisheries Working Committee, are
confirmed as the tāngata whenua of the area/rohe moana to
which the appointment of Tāngata Kaitiaki relates.

  1. Power to authorise the taking of fisheries resources for
    customary food gathering
    —The Tāngata Kaitiaki may
    authorise any individual to take fisheries resources managed
    under the Fisheries Act 1996, other than those resources that
    are taken in fresh water, for customary food gathering
    purposes from within the whole or any part of the area/rohe
    moana. No customary food gathering of fisheries resources
    may take place in the area/rohe moana without an
    authorisation from a Tāngata Kaitiaki.

Fisheries (Kaimoana Customary Fishing) Notice
(No. 18) 2004 (No. F307)

Pursuant to Regulations 9 and 10 of the Fisheries (Kaimoana
Customary Fishing) Regulations 1998, a senior fisheries
management advisor of the Ministry of Fisheries (acting
pursuant to a delegated authority in accordance with section
41 of the State Sector Act 1998) hereby gives the following
notice.

Notice

  1. Title and commencement—(1) This notice may be
    cited as the Fisheries (Kaimoana Customary Fishing) Notice
    (No. 18) 2004.

(2) This notice shall come into effect the day after the date
of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) “customary food gathering” has the same meaning
as defined in the Fisheries (Kaimoana Customary
Fishing) Regulations 1998.

(b) The term “Kaitiaki” is a local dialect word that has
the same meaning as “Tāngata Kaitiaki/Tiaki”, a
term that is defined in the Fisheries (Kaimoana
Customary Fishing) Regulations 1998.

  1. Cancellation of Kaitiaki—Te Hika o Papauma, being
    the tāngata whenua who nominated Matai Hamuera
    Broughton, Henry James Power, Pikihuia Monica Wilton
    and William Wright as Kaitiaki, has requested in writing the
    cancellation of the appointment of the late Henry James
    Power as a Kaitiaki.

  2. Cancellation of appointment—The Associate Minister
    of Fisheries (acting pursuant to a delegated authority)
    hereby confirms the cancellation of the appointment of the
    late Henry James Power as a Kaitiaki for managing
    customary food gathering within the area/rohe moana
    defined above in 2 (d) (i).

  3. Appointment of Kaitiaki—The Associate Minister of
    Fisheries (acting pursuant to a delegated authority) hereby
    confirms the appointment of Wright Wiremu Broughton as a
    replacement Kaitiaki to manage customary food gathering
    for the area/rohe moana defined above in 2 (d) (i), and
    Patrick Michael Gilbert Dewar as an additional Kaitiaki for
    the area/rohe moana defined above in 2 (d) (ii).

  4. Confirmation of tāngata whenua—Te Hika o Papauma
    is confirmed as the tāngata whenua of the area/rohe moana
    to which the appointment of Kaitiaki relates.

  5. Power to authorise the taking of fisheries resources
    for customary food gathering
    —The Kaitiaki may
    authorise any individual to take fisheries resources managed
    under the Fisheries Act 1996, other than those resources that
    are taken in fresh water, for customary food gathering
    purposes from within the whole or any part of each
    area/rohe moana for which they have been appointed as
    Kaitiaki. No customary food gathering of fisheries resources
    may take place in the area/rohe moana without an
    authorisation from the Kaitiaki.
