Land Transfer Act Notice

The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of an easement.
The applicants claim the easement is redundant by reason of the circumstances set out below. I intend to remove the easement
on the 15th day of November 2004, if no objections have been received before that date.

Application No.: 6011374.2.

Applicants: Mitchell Gates and Kathryn Gates, care of Public Trust Legal Services, Level One, 9 Margaret Street, Lower Hutt.

Easements: Right of way specified in easement certificate 125272; shown on DP 9070.

Circumstances: Part of the dominant tenement has become physically separated from the servient tenement as a result of subdivision shown on DP 332229.

Notice is hereby given that a Computer Freehold Register will be issued in the name of the applicants for the parcel of land hereinafter described, pursuant to section 20 of the Land Transfer Act 1952, unless a caveat is lodged forbidding the same before the 15th day of November 2004:

Application: 5992228.3.

Applicants: Allan Costley Jones, Shirley Alma Jones and Alastair Graeme Flett.

Land: Parts of the Old River Bed of Taringamotu River, shown as part of Lot 1 (1.5180 hectares, more or less) and Lot 3 (3760 square metres, more or less) on LT 314268 up to the centre line between the land owned by the applicants hereof (being Computer Freehold Register SA659/292) and the adjoining land in Computer Freehold Register SA685/213.

Circumstances: The applicants are the owners of Ohura South A1B1B (CT SA659/292) which adjoins the Old River Bed of Taringamotu River. The applicants claim ownership of part of the Old River Bed of Taringamotu River to its centreline and have applied to me for the issue of a Computer Freehold Register.

Section 27 of the Incorporated Societies Act 1908

Take notice that the Registrar of Incorporated Societies has directed that consequent on the dissolution of the above-named society at an unknown date its surplus asset, being the land in the Schedule hereto, be vested in the Hauraki District Council.

This direction shall become final on the 15th day of November 2004.

No appeal shall lie unless notice thereof is delivered on or before that date.

Schedule

An estate in fee simple in all that parcel of land containing 1,012 square metres, more or less, being Lot 2, Section 1, Block XVI, Piako Survey District, being all the land identified as SA279/243 (South Auckland Land Registration District).
