Civil Aviation Rules—Summary of Exemptions Granted by the Director of Civil Aviation

In accordance with section 37 (3) of the Civil Aviation Act 1990, notification is hereby given that the Director of Civil Aviation has granted the following exemptions from the Civil Aviation Rule requirements:

Schedule

4/EXE/17, 4/EXE/19 and 4/EXE/21:
61.35 (a) (1) – medical requirement for a pilot holding a licence issued under Part 61.

4/EXE/18, 4/EXE/20 and 4/EXE/22:
61.153 (a) (2) – eligibility requirements for issue of a private pilot licence.

4/EXE/28 and 4/EXE/32:
61.105 (2) – requirement to hold a current medical certificate issued under the Act.

4/EXE/31:
91.629 (a) (3), (4), (5), (8) and (9) (ii) – requirements with respect to the aircraft technical log.

4/EXE/33:
91.111 (2) – requirement to carry the aircraft flight manual.

3/EXE/59:
139.203 (a) – requirement for security fencing.

Notice of the grant, withdrawal or denial of exemptions with provisos is published in the Civil Aviation Rules Register Information Leaflet (CARRIL).

Traffic Regulations 1976

Exemption of Certain Types of Motor Vehicle From the Alternative Fuel Regulation of the Traffic Regulations 1976 Relating to Fuelling

Pursuant to Regulation 90 (1) of the Traffic Regulations 1976 and under delegated authority, I exempt the types of motor vehicle specified in the Schedule from the requirements of Regulation 90O of the Traffic Regulations 1976.

The exemption takes effect from 1 March 2004.

Schedule
Motor Vehicle Types:
Motorcar, Omnibus, and Goods Vehicle and vehicles of any of these types that have been converted for use as motorhomes, that operate on compressed natural gas (CNG) or liquefied petroleum gas (LPG), to which Regulations 90A to 90Q of the Traffic Regulations 1976 apply.

Explanatory Note

This exemption applies to vehicles equipped with alternative fuel systems to which Regulations 90A to 90Q of the Traffic Regulations 1976 apply, specifically those operating on compressed natural gas (CNG) and liquefied petroleum gas (LPG). The exemption removes the requirement for these vehicles to have the currency of their alternative fuels inspection certificates checked prior to being fuelled with CNG or LPG. The rationale for this is the regular inspection of alternative fuel systems that is now required by Land Transport Rule: Vehicle Standards Compliance 2002 as a prerequisite to in-service certification. The exemption also takes account of safety improvements that have occurred since the fuelling offence provision (Regulation 90O of the Traffic Regulations 1976) came into effect on 1 March 1982.
