Social Security Act 1964

Home Help Amendment 2004

Pursuant to section 124 (1) (d) of the Social Security Act 1964, the Minister for Social Development and Employment establishes and approves the following amendment to the Home Help Programme (as established and approved on 6 May 2004).

Amendment

  1. Title—(1) This amendment is the Home Help Amendment 2004.

(2) In this amendment, the Home Help Programme is called "the programme".

  1. Commencement—This amendment comes into effect on the day after the date on which it is published in the New Zealand Gazette.

  2. Interpretation—Clause 4 (1) of the programme is amended by revoking the definitions of family credit income and net income.

  3. New clause 7 substituted—The programme is amended by revoking clause 7, and substituting the following clause:

"7 Financial means test for certain applicants

(1) An applicant meets the financial means test referred to in clause 6 (1) (c) (iii) and (d) (ii) if—

(a) either the applicant or the applicant’s spouse holds a community services card issued under the Health Entitlement Cards Regulations 1993; and

(b) the value of the cash assets of the applicant and his or her spouse is less than the appropriate cash assets limit set out in subclause (2).

(2) The cash assets limit referred to in subclause (1) is—

(a) $7,464.00 in the case of an applicant who is married or a sole parent; or

(b) $4,300.00 in any other case.

(3) Where an applicant’s spouse is receiving care in a hospital care institution or a rest home or a residential disability care institution (within the meaning of the Health and Disability Services (Safety) Act 2001), only 50% of the cash assets of the applicant and the applicant’s spouse must be counted as their cash assets."

  1. Revocation—Clause 11 of the programme is amended by omitting the words "Social Security" and substituting the words "Social Welfare".

  2. Transitional provision—Nothing in this amendment affects any home help assistance granted to an applicant before this amendment comes into effect.

Explanatory Note

This note is not part of the amendment, but is intended to indicate its general effect.

This amendment, which comes into effect on the day after its publication in the New Zealand Gazette, simplifies the financial means test in clause 7 of the Home Help Programme to one based on holding a community services card.
