Notice of Application for Approval of a Scheme Varying
the Terms of a Will

In the High Court of New Zealand, Blenheim Registry

In the matter of Part III of the Charitable Trusts Act 1957,
and in the matter of a charitable trust created by the
will of Isabel Bursill, late of Blenheim, deceased,

Presbyterian Support (Upper South Island), a body
corporate having its registered office at Christchurch as
trustee of the will of the said Isabel Bursill—Applicant:

Notice is hereby given that an application has been brought
by the above-named applicant, which is the trustee of a
charitable trust created by the will of Isabel Bursill who
died at Blenheim on 6 November 1963.

The trustee is seeking the approval of the Court to be given
to a scheme under Part III of the Charitable Trusts Act 1957
providing for disposal of the trust property for some other
charitable purpose, namely:

(a) The proceeds available from the sale of the Isabel
Bursill Home, formerly conducted at Blenheim, be
applied to establish a fund.

(b) The fund be invested by the trustee in such
investments as the trustee is authorised by the
rules of the trust.

(c) The income and capital from the fund be applied to
provide care and support, whether by way of
meals, transport, assistance with home and garden
maintenance, and nursing or medical care for elderly
men and women who do not have the financial
resources to make their own provision for such care.

The date proposed for the hearing of the application by the
High Court at Blenheim is the 4th day of September 2003 at
10.00 a.m.

Any person desiring to oppose the scheme should give
written notice of his or her intention to do so to the
Registrar of the High Court at Blenheim and to the trustee,
Presbyterian Support (Upper South Island), care of Crichton
Loach, Solicitors, Second Floor, New Zealand Post Building,
2 Main Street (P.O. Box 614), Blenheim, and to the
Attorney-General, care of the Crown Law Office, St Paul’s
Square, 45 Pipitea Street (P.O. Box 5012), Wellington.

Such notice must be given not less than seven clear days
before the date of hearing.
