Declaration by Chief Electoral Officer That Moana Lynore Mackey is Elected a Member of Parliament
WHEREASβ
A. I have received a warrant from Her Excellency the Governor-General, to supply a member of Parliament to fill a vacancy created by the resignation of Graham Desmond Kelly;
B. Under section 137 (2) of the Electoral Act 1993, I have determined that of the unelected candidates on the party list of the New Zealand Labour Party, Moana Lynore Mackey stood highest in the order of preference on that list;
C. Under section 137 (3) of that Act, I have asked the Secretary of the New Zealand Labour Party whether Moana Lynore Mackey remains a member of that party and I have been informed by the Secretary of the New Zealand Labour Party that she remains a member of that party;
D. Under section 137 (4) of that Act, I have asked Moana Lynore Mackey whether she is willing to be a member of Parliament and she has indicated her willingness to be a member of Parliament;
THEREFORE, pursuant to section 137 (4) of that Act, I, David Robert Henry, Chief Electoral Officer, declare that Moana Lynore Mackey is elected as a member of Parliament upon publication of this declaration in the New Zealand Gazette.
