Fisheries (Kaimoana Customary Fishing) Regulations 1998
Fisheries (Kaimoana Customary Fishing) Notice (No. 11) 2003 (No. F246)
Pursuant to Regulation 9 (2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, a senior fisheries management advisor, Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988), hereby gives the following notice.

Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 11) 2003.
(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

Interpretation—In this notice:
(a) “mahi kaimoana” are local dialect words that have the same meaning as “customary food gathering”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) “ngā taunga ika” are local dialect words that have the same meaning as “fisheries resources”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(c) “Kaitiaki” is a local dialect word that has the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(d) Any reference to “Kaitiaki” means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 as Tangata Kaitiaki/Tiaki for mahi kaimoana within the area/rohe moana and confirmed in clause 3 of this notice.
(e) Any reference to “area/rohe moana” means the area described by a line beginning on the coastline at Potikirua Point (37° 32.5′ S and 178° 04.9′ E), then due north to a point on the 12 nautical mile limit line (37° 20.4′ S and 178° 04.9′ E), then generally east along the 12 nautical mile line to a point (37° 21.9′ S and 178° 23.6′ W), then generally south-west to Midway Point (37° 32.4′ S and 178° 13.0′ E), then generally east along the coastline to the point of commencement (derived from WGS84 datum).

Appointment of Kaitiaki—The Associate Minister of Fisheries (acting pursuant to a delegated authority) hereby confirms the appointment of the Potaka Marae Committee members for managing mahi kaimoana within the area/rohe moana.

Confirmation of tangata whenua—Tapaeururangi, as represented by the Potaka Marae Committee, is confirmed as the tangata whenua of the area/rohe moana to which the appointment of Kaitiaki relates.

Power to authorise taking of fisheries resources for mahi kai moana—The Kaitiaki may authorise any individual to take ngā taunga ika managed under the Fisheries Act 1996, other than those ngā taunga ika that are taken in fresh water, for mahi kaimoana purposes from within the whole or any part of the area/rohe moana. No mahi kai moana of ngā taunga ika may take place in the area/rohe moana without authorisation from the Kaitiaki.

Appointment of Kaitiaki—The Associate Minister of Fisheries (acting pursuant to a delegated authority) hereby confirms the appointment of:
(a) Henry James Power to manage customary food gathering within the area/rohe moana described by a line beginning on the coastline at Poroporo (40° 27.0′ S and 176° 37.5′ E), then east to the 12 nautical mile limit to reference point (40° 27.0′ S and 176° 53.0′ E), then south-west along the 12 nautical mile limit to reference point (40° 52.0′ S and 176° 30.5′ E), then west to Mataikona (40° 47.0′ S and 176° 16.0′ E) and then north-east following the coastline to the point of commencement; and
(b) William Wright to manage customary food gathering within the area/rohe moana described by a line beginning on the coastline at Poroporo (40° 27.0′ S and 176° 37.5′ E), then east to the 12 nautical mile limit to reference point (40° 27.0′ S and 176° 53.0′ E), then south-west along the 12 nautical mile limit.
