Land Act 1948

Reservation of Lands, Classification of Reserves, and Appointment to Control and Manage Reserves

Under the Land Act 1948, the Auckland Conservator for the Auckland Conservancy of the Department of Conservation sets apart the land described in the First Schedule as a recreation reserve, subject to the provisions of section 17 of the Reserves Act 1977, and sets apart the land described in the Second Schedule as a local purpose (refuse management) reserve, subject to section 23 of the Reserves Act 1977,

and further, under the Reserves Act, classifies the reserve described in the First Schedule as a recreation reserve and classifies the reserve described in the Second Schedule as a local purpose (refuse management) reserve,

and further, appoints the Auckland City Council and the Ngati Paoa Whanau Trust Board to jointly control and manage the reserve for recreation purposes described in the First Schedule, and the Auckland City Council to control and manage the reserve for local purpose (refuse management) described in the Second Schedule.

North Auckland Land District—Auckland City

First Schedule

8022 square metres, being Lot 2, D.P. 207850. No registration.

Second Schedule

1686 square metres, being Lot 3, D.P. 207850. No registration.

Both situated in Block VI, Waiheke Survey District.

A Proclamation

Pursuant to the Public Works Act 1981, I, The Honourable Dame Silvia Cartwright, Governor-General of New Zealand, hereby declare the land described in the Schedule hereto to be taken for motorway purposes and to vest in the Crown on the 14th day after the date of the publication of this Proclamation in the New Zealand Gazette.

(a) 1 square metre; shown as “Section 3” on S.O. Plan 38222, being part of Section 115, Town of Wellington, and being part of the land in Deeds Index 12/660.

(b) 1 square metre; shown as “Section 4” on S.O. Plan 38222, being part of Section 115, Town of Wellington, and being part of the land in Deeds Index 12/660.

Together the two parcels described in this Schedule make up the balance of the land held in Deeds Index 12/660.
