Gibson Bradbury, Deputy Secretary Air Services in the Ministry of Transport, having received an application from Polynesian Limited, of Apia, Samoa (trading as Polynesian Airlines), has:

(a) granted that airline an open aviation market licence to carry on scheduled services and non-scheduled flights for an indefinite term with effect from 27 January 2003; and

(b) varied the scheduled international air service licence granted to the airline to provide for that licence to expire on 27 January 2003.

Traffic Regulations 1976

Exemption From a Specified Requirement of the Traffic Regulations 1976

Pursuant to Regulation 90 (1) of the Traffic Regulations 1976, and pursuant to the powers delegated to me by the Director of Land Transport Safety, I, Laszlo Andras Hidvegi, Senior Engineer Safer Vehicles Policy, hereby exempt the vehicles specified in Schedule 1 of this notice from the requirements in Schedule 2.

Schedule 1
All forklifts.

Schedule 2
Regulation 70 (1) of the Traffic Regulations 1976, prohibiting vehicles to have their steering wheels to the left of the longitudinal centreline of their body.

This exemption may be revoked at any time.

Exemption From Specified Requirements of the Traffic Regulations 1976

Pursuant to Regulation 90 (1) of the Traffic Regulations 1976 (hereinafter β€œTR1976”), and pursuant to the powers delegated to me by the Director of Land Transport Safety, I, Laszlo Andras Hidvegi, Senior Engineer Safer Vehicles Policy, hereby exempt the vehicles specified in Schedule 1 of this notice from the requirements in Schedule 2, until the time in Schedule 3.

Schedule 1
All forklifts.

Schedule 2

  1. Regulation 59 of the TR1976, requiring two forward facing side lamps to be fitted if the width of the vehicle exceeds 1.5m.

  2. Regulation 60 (2) (a) of the TR1976, requiring rearward facing side lamps to be not more than 1.5m above the ground.

  3. Regulation 61 (2) (a) of the TR1976, requiring stop lamps to be not more than 1.5m above the ground.

  4. Regulation 62 (2) of the TR1976, requiring rear reflectors to be not more than 1.5m above the ground.

  5. The requirement in Regulation 63 (2) (a) of the TR1976, according to which the direction indicator lamps must be not more than 1.5m above the ground.

Schedule 3
This exemption will lapse on the day when Land Transport Rule: Vehicle Lighting (Rule 32005) comes into force.

Approval of the Fitting of Specified Equipment to Motor Vehicles

Pursuant to Regulations 67 (8) and 88 (1) of the Traffic Regulations 1976 and pursuant to the powers delegated to me by the Director, I, Laszlo Andras Hidvegi, Senior Engineer Safer Vehicles Policy, approve the fitting of the lamps specified in Schedule 1 of this notice to vehicles in Schedule 2, subject to the conditions in Schedule 3, until the time specified in Schedule 4.

Schedule 1
A vehicle in Schedule 2 may be permanently fitted with the following lamps:

  1. One or more flashing or revolving yellow or amber lamps.

  2. One or more scene lamps or working lamps, in addition to the auxiliary lamps allowed in Regulation 65 of the Traffic Regulations 1976, emitting white light to illuminate the immediate working area where the vehicle is operated.

Schedule 2
All forklifts.

Schedule 3

  1. The lamps permitted in point 1 of Schedule 1 may only be used while the vehicle is being operated on the road when the usage of such lights are required in the transport law, for example according to the requirements in Land Transport Rule: Vehicle Dimensions and Mass 2002 (Rule 41001).

  2. The lamps permitted in point 2 of Schedule 1 must not be used while the vehicle is operated on the road, except when operated on the road for the specific purpose the vehicle is designed for, such as lifting and shifting loads.

Schedule 4
This approval will lapse on the day when Land Transport Rule: Vehicle Lighting (Rule 32005) comes into force.
