(c) he or she:

(i) is currently the holder of the relevant first-class mine manager’s certificate under the Mining Act 1971, the Coal Mines Act 1979 or Regulations made under the Health and Safety in Employment Act 1992; and

(ii) has had at least 12 months’ experience in an opencast coal mine.

Certificate of Competence as an A-grade Quarry Manager

(1) The holder of a certificate of competence as an A-Grade quarry manager must have the qualifications and experience set out in paragraphs (2) and (3).

(2) The holder must have passed:

(a) the unit standards set out in Groups 1 and 2 of the Appendix; and

(b) if the holder works in an operation where explosives are used, the unit standards set out in Group 14 of the Appendix.

(3) The holder must satisfy the secretary that:

(a) he or she has had, in the aggregate, at least 2 years’ experience in the workings of an opencast mine or quarry; or

(b) he or she has had, in the aggregate, at least 12 months’ experience in the workings of an opencast mine or quarry and at least 2 years’ experience in the underground workings of a mine, coal mine or tunnel; or

(c) he or she:

(i) is currently the holder of the relevant first-class mine manager’s certificate under the Mining Act 1971, the Coal Mines Act 1979 or Regulations made under the Health and Safety in Employment Act 1992; and

(ii) has had at least 12 months’ experience in an opencast mine or quarry.

Certificate of Competence as a B-Grade Quarry Manager

(1) The holder of a certificate of competence as a B-grade quarry manager must have the qualifications and experience set out in paragraphs (2) and (3).

(2) The holder must have passed:

(a) the unit standards set out in Group 1 of the Appendix; and

(b) if the holder works in an operation where explosives are used, the unit standards set out in Group 14 of the Appendix.

(3) The holder must satisfy the secretary that:

(a) he or she has had, in the aggregate, at least 2 years’ experience in the workings of an opencast mine or quarry; or

(b) he or she has had, in the aggregate, at least 12 months’ experience in the workings of an opencast mine or quarry and at least 2 years’ experience in the underground workings of a mine, coal mine or tunnel; or

(c) he or she:

(i) is currently the holder of a relevant first-class mine manager’s certificate under the Mining Act 1971, the Coal Mines Act 1979 or Regulations made under the Health and Safety in Employment Act 1992; and

(ii) has had at least 12 months’ experience in an opencast mine or quarry.

Certificate of Competence A-grade Tunnel Manager

(1) The holder of a certificate of competence as an A-Grade tunnel manager must have the qualifications and experience set out in paragraphs (2) and (3).

(2) The holder must have passed:

(a) the unit standards set out in Groups 8, 9 and 10 of the Appendix; and

(b) if the holder works in an operation where explosives are used, the unit standards set out in Group 14 of the Appendix.

(3) The holder must satisfy the secretary that:

(a) he or she has had, in the aggregate, at least 2 years’ experience in the workings of a tunnel; or

(b) he or she has had, in the aggregate, at least 12 months’ experience in the workings of a tunnel and at least 2 years’ experience in the underground workings of a mine or coal mine; or

(c) he or she:

(i) is currently the holder of a relevant first-class mine manager’s certificate under the Mining Act 1971, the Coal Mines Act 1979 or Regulations made under the Health and Safety in Employment Act 1992; and

(ii) has had at least 12 months’ experience in a tunnel.

Certificate of Competence as a B-grade Tunnel Manager

(1) The holder of a certificate of competence as a B-grade tunnel manager must have the qualifications and experience set out in paragraphs (2) and (3).

(2) The holder must have passed:

(a) the unit standards set out in Group 8 of the Appendix; and

(b) if the holder works in an operation where explosives are used, the unit standards set out in Group 14 of the Appendix.

(3) The holder must satisfy the secretary that:

(a) he or she has had, in the aggregate, at least 2 years’ experience in the workings of a tunnel; or

(b) he or she has had, in the aggregate, at least 12 months’ experience in the workings of a tunnel and at least 2 years’ experience in the underground workings of a mine or coal mine; or

(c) he or she:

(i) is the holder of a relevant first-class mine manager’s certificate under the Mining Act 1971, the Coal Mines Act 1979 or Regulations made under the Health and Safety in Employment Act 1992; and

(ii) has had at least 12 months’ experience in a tunnel.
