New Zealand Public Health and Disability Act 2000
Revocation of Notice to Pharmacists in the Northern, Midland and Central Regions, and Revocation of Notice to Pharmacists in the Southern Region
Pursuant to section 88 of the New Zealand Public Health and Disability Act 2000, issued by the Director-General of Health as an agent of all District Health Boards:
Revocation of Notice to Pharmacists in the Northern, Midland and Central Regions given by the Health Funding Authority on 1 October 1998 (a notice originally given under section 51 of the Health and Disability Services Act 1993, which set out the terms and conditions upon which the Health Funding Authority would make payment to pharmacists in those regions), continued by section 112 (3) of the New Zealand Public Health and Disability Act 2000 as a notice issued under section 88 of that Act.
Revocation of Notice to Pharmacists in the Southern Region given by the Southern Division of the Transitional Health Authority on 1 December 1997 (a notice originally given under section 51 of the Health and Disability Services Act 1993, which set out the terms and conditions upon which the Transitional Health Authority would make payment to pharmacists in that region), continued by section 112 (3) of the New Zealand Public Health and Disability Act 2000 as a notice issued under section 88 of that Act.
Notice
- Background—From 1 October 1998, the former Health Funding Authority made payments to pharmacists in the Northern, Midland and Central Regions pursuant to a notice issued under section 51 of the Health and Disability Services Act 1993. From 1 December 1997, the former Transitional Health Authority made payments to pharmacists in the Southern Region pursuant to a notice issued under section 51 of the Health and Disability Services Act 1993 (hereafter referred to as “the principal notices”).
The principal notices set out the terms and conditions on which the Health Funding Authority and/or the Transitional Health Authority would make payment to pharmacists in the relevant region for their services.
When the Health and Disability Services Act 1993 was repealed, the principal notices were continued as section 88 notices under section 112 (3) of the New Zealand Public Health and Disability Act 2000.
The Ministry of Health’s obligations were transferred under the principal notice to District Health Boards by means of the Health Sector Transfers (Provider Arrangements) Order 2001 (S.R. 2001/135).
No claims for payment for services are currently made by pharmacists in the regions under the principal notices. In order to implement a new section 88 notice for community pharmacy services, the principal notices need to be revoked.
The Director-General of Health, acting as agent of the District Health Boards, with the written approval of the Minister of Health, issues this revocation to the principal notices.
- Commencement—This notice comes into force on 31 December 2003.
Dated at Wellington this 13th day of October 2003.
DR KAREN O. POUTASI, Director-General of Health.
Explanatory Note
This notice, which comes into force on 31 December 2003, revokes two notices given under section 51 of the Health and Disability Services Act 1993 to pharmacists in the Northern, Midland and Central Regions, and to pharmacists in the Southern Region by the Health Funding Authority and/or the Transitional Health Authority (“the principal notices”) which came into force on 1 October 1998 and 1 December 1997 respectively.
The principal notices were deemed by section 112 (3) of the New Zealand Public Health and Disability Act 2000 to continue in force as if they had been given by the Crown under section 88 of that Act.
Responsibility for the principal notices was transferred to District Health Boards under section 5 of the Health Sector (Transfers) Act 1993 by the Health Sector Transfers (Provider Arrangements) Order 2001 (S.R. 2001/135).
Accordingly, this notice is given under section 88 of the New Zealand Public Health and Disability Act 2000 by the Director-General of Health who has been appointed as agent of all District Health Boards for the purpose of giving this notice.
