NEW ZEALAND GAZETTE

The following functions, powers and duties of the board are
vested in the limited statutory manager:

● Managing the transition and implementation of the
board’s strategic direction as a national school for
students who are blind and vision impaired;
● curriculum management in relation to the education
programme;
● the employment powers of the board; and
● health and safety management in relation to providing a
safe emotional and physical environment.

The limited statutory manager must also advise the board on
the following:

● Provide mentoring and support for the board of trustees.

The following conditions apply to the exercising of the
powers of the board and the limited statutory manager:

● The powers of the limited statutory manager shall be
exercised in consultation with the board; and
● the limited statutory manager shall liaise with contractors
and the board to guide decision making that will place
the school on a sound educational footing.

This notice takes effect the day after the date of publication
of this notice.

Notice of Appointment of a Limited Statutory
Manager for the Board of Trustees of
Waerenga-O-Kuri School (2712)

Pursuant to section 78M of the Education Act 1989, I direct
the Secretary for Education to appoint a limited statutory
manager for the Waerenga-O-Kuri School Board of Trustees
because of risks to the operation of the school and the
educational performance of the students.

The following functions, powers and duties of the board are
vested in the limited statutory manager:

● Employment powers of the board;
● board organisation and management; and
● ensuring the new planning and reporting requirements
are met.

The limited statutory manager must also advise the board on
the following:

● Board roles and responsibilities; and
● consolidating all new and improved systems into board
management practice.

This notice takes effect the day after the date of publication
of this notice.

Managers at Kaikohe Intermediate School (1022)

Pursuant to section 78M of the Education Act 1989, I direct
the Secretary for Education to appoint two limited statutory
managers for Kaikohe Intermediate School because of risks
to the operation of the school, welfare of students and
educational performance of the students at the school.

The following functions, powers and duties of the board are
vested in limited statutory manager one:

● Development of board processes;
● strategic planning and self review;
● policy and procedural development; and
● compliance with health and safety requirements.

The following functions, powers and duties of the board are
vested in limited statutory manager two:

● Employment powers of the board; and
● curriculum management.

The limited statutory managers must also advise the board
on the following:

● Methods to address the issues in the action plan arising
from the recent Education Review Office reports.

This notice takes effect the day after the date of publication
of this notice.

Fisheries (South Island Customary Fishing)
Regulations 1999

Fisheries (South Island Customary Fishing) Notice
(No. 47) 2003 (No. F265)

Pursuant to Regulation 10 of the Fisheries (South Island
Customary Fishing) Regulations 1999, and acting under
delegated authority, the Associate Minister of Fisheries
hereby gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be
    cited as the Fisheries (South Island Customary Fishing)
    Notice (No. 47) 2003.

    (2) This notice shall come into effect the day after the date
    of its notification in the New Zealand Gazette.

  2. Interpretation—In this notice:

    (a) “customary food gathering” has the same meaning
    as defined in the Fisheries (South Island Customary
    Fishing) Regulations 1999.

    (b) “Tāngata Tiaki/Kaitiaki” means the person or
    persons appointed under Regulation 9 of the
    Fisheries (South Island Customary Fishing)
    Regulations 1999 as Tāngata Tiaki/Kaitiaki for the
    area/rohe moana described in clause 2 (c).

    (c) “the area/rohe moana” means the area/rohe moana
    from Abut Head to Piopiotahi (Milford Sound),
    extending seaward to the limit of the South Island
    fisheries waters as defined under Regulation 2 of
    the Fisheries (South Island Customary Fishing)
    Regulations 1999 and inland to the boundaries
    defined for Te Rūnanga o Makāwhio in the First
    Schedule of Te Rūnanga o Ngāi Tahu Act 1996.

  3. Cancellation of Tāngata Tiaki/Kaitiaki—Te Rūnanga
    o Makāwhio, being the Tāngata Whenua who nominated
    Gordon McLaren as Tāngata Tiaki/Kaitiaki for the area/rohe
    moana, has requested in writing the cancellation of the
    appointment of Gordon McLaren as Tāngata Tiaki/Kaitiaki.

  4. Cancellation of Appointment—The Associate Minister
    of Fisheries hereby confirms the cancellation of the
    appointment of Gordon McLaren as Tāngata Tiaki/Kaitiaki
    for managing customary food gathering for the area/rohe
    moana.
