Land Transfer Act Notice

Notice is hereby given that the parcel described in the Schedule will be brought under the Land Transfer Act 1952, unless a caveat is lodged forbidding the same before the 6th day of November 2003, lodged under application 5724222.1 by the Christchurch City Council.

Part Lots 1 (350 square metres) and 3 (510 square metres), D.P. 316694, containing 860 square metres and being part of the land shown as stream bed (St Albans Creek) on Land Transfer Plan 316694.

Notice Pursuant to Section 70 of the Land Transfer Act 1952

The applicant described below has applied under section 70 of the Land Transfer Act 1952 for the removal of an easement. The applicant claims the easement is redundant by reason of the circumstances set out below.

I intend to remove the easement on the 7th day of November 2003 if no objections have been received before that date.

Description of Easement: A right to convey water contained in Transfer A369122.2 insofar as they are subject to certificates of title 53005, 53010, 71673-71675, 84317, 84319-84320, 84323-84328, 84364-84365, 84367-84368, 84385-84388, 84397-84398, 84401, 84405-84406, 84415 and 84420.

Circumstances: Part of the dominant tenement has become physically separated from the servient tenement as a result of subdivision.

Alexander Turnbull Library Endowment Trust

Application for Approval of a Scheme of Variation

Take notice that the Alexander Turnbull Library Endowment Trust Board will make application to the High Court in Wellington on the 17th day of November 2003 at 10.00 a.m., for approval of a scheme under Part 3 of the Charitable Trusts Act 1957 to vary the trust deed and in particular:

  1. to vary the objects of the trust so as to include research-related activities associated with the Alexander Turnbull Library;
  2. to modernise a number of references in the trust deed;
  3. to amend provisions as to board membership and quorum, and as to auditing requirements; and
  4. to insert new provisions permitting payout through intermediaries, regulating the taking of investment advice, resolving disputes by obtaining counsel’s opinion, allowing the trustees by special majority to vary the trust deed (including, subject to Attorney-General approval, the objects of the trust) and limiting the liability of the trustees.

Any person desiring to oppose the application is required to give written notice of his/her intention to do so to the Registrar of the High Court, to the Attorney-General and to the trustees not less than seven clear days before the 17th day of November 2003.

This notice is advertised in accordance with section 36 of the Charitable Trusts Act 1957.
